Inspector identifies multiple land management violations in Dong Nai

According to the inspection conclusion on the compliance with the law in the field of natural resources and the environment in Dong Nai province, in addition to the achieved results, the provincial People's Committee also identified some existing issues in land management.

The Ministry of Natural Resources and Environment has just announced the conclusion of the inspection of compliance with laws in the field of natural resources and environment in Dong Nai province.

Accordingly, in addition to the achieved results, Dong Nai Provincial People’s Committee also has some shortcomings in land management. Specifically, the Provincial People’s Committee instructed the investor of the residential area construction investment project to implement land transfer without auctioning the land use rights, not in accordance with the land law regulations. The identification of land users when reclaiming land is not in line with the actual land use, and the content of land use plans is not consistent with urban planning.

The provincial People’s Committee issued a legal document on the minimum agricultural land area for land separation (at the time of 2014 and 2016) when land laws have not yet been transferred to the Provincial People’s Committee for regulation.

In addition, the People’s Committee of Long Khanh City, Nhon Trach District, and Long Thanh District still have many problems in land separation and consolidation. Nhon Trach District People’s Committee allows individual households to convert agricultural land to residential land, and there are some files missing the document verifying the demand for residential land use.

In view of the above problems, the Ministry of Natural Resources and Environment proposed that Dong Nai Provincial People’s Committee rectify and improve the land transfer, land use conversion, land use rights auctioning, land separation, and consolidation in order to improve the state management of land and enhance the efficiency of land use.

Direct relevant agencies to immediately rectify the existing limitations and restrictions in land transfer, land leasing, land separation, and land use conversion.

Direct the handling of land transfer to Long Thanh Riverside Joint Stock Company to implement the residential area construction investment project without auctioning the land use rights, not in accordance with Article 118 of the Land Law.

Direct the People’s Committees of districts and cities to immediately suspend the transfer, donation, and return of land use rights to the state for use in the construction of technical infrastructure works in land parcels applied for land separation but not in accordance with regulations.

Direct the handling of LDG Investment Corporation’s progress delay in the construction of projects under investment and Quang Vinh Trading and Services Co., Ltd.’s continuous delay of more than 12 months in using the land allocated for the mentioned projects in accordance with legal regulations.

The Ministry also suggested that Dong Nai Provincial People’s Committee develop medium and small-scale housing projects suitable for the local reality (especially rural areas) to meet the timely housing and residential land needs of the people, and create opportunities for people who do not have access to housing and residential land in new urban areas.
