La Gi Land Reclamation Project Entangled in Violations, Illegally Mobilizing 535 Billion VND

The Lam Dong Provincial Inspectorate has uncovered a series of violations at the La Gi coastal reclamation project, revealing that the developer signed 335 contracts in breach of capital mobilization regulations.

The Lam Dong Provincial Inspectorate has recently issued a specialized conclusion, highlighting numerous persistent issues and obstacles in the La Gi New Urban – Commercial – Service Area Land Reclamation Project. The project, developed by Vi Nam Construction – Trading and Service Co., Ltd. (Vi Nam Company), is located in Phuoc Hoi Ward.

The primary violations revolve around illegal real estate transactions and delays in land classification and planning for the expansion phase.

According to the inspection findings, despite the Department of Construction not yet confirming the project’s eligibility for land transfer, Vi Nam Company has signed 335 contracts titled “Progress and Conditions for Land Use Rights Transfer.”

Through these contracts, the developer has collected over 535 billion VND. This action has been deemed non-compliant with the current Law on Real Estate Business, despite previous warnings from the Department of Construction.

Notably, Phase 2 of the project, covering 25.42 hectares, is currently stalled. The expanded land area has yet to be classified by the competent authority, which is essential for land allocation and leasing procedures.

In addition to planning and business hurdles, the project faces land disputes with 12 individuals who have re-encroached on Phase 1 land. Vi Nam Company has filed a lawsuit, but the case is currently suspended.

Furthermore, the developer has not fulfilled its financial obligations related to the transfer of capital contributions from members, specifically the land registration fee.

The Lam Dong Provincial Inspectorate recommends that the Provincial People’s Committee direct relevant departments and Phuoc Hoi Ward’s People’s Committee to promptly resolve land classification issues for Phase 2 and complete detailed zoning plans.

The inspection agency also urges Vi Nam Company to coordinate with the court to definitively resolve land disputes with the 12 individuals, ensuring legal compliance before proceeding with the project.
