The Government Inspector has identified multiple violations in land management and mineral exploitation in Ninh Binh province, while also demanding thorough investigation and resolution of these existing issues.

Several violations in large-scale projects

Besides the achieved results, the Government Inspectorate has pointed out several violations in the joint inspection conclusions concerning land management, land use permits for exploiting land and stone mines for construction materials, and planning work in Ninh Binh province.

Specifically, by inspecting 18 projects (16 land use projects and 2 mineral exploitation projects), many deficiencies and violations were found. Among them, 7/18 projects have limitations in terms of planning work, such as: approval of incorrect scale planning, failure to adjust general planning, lack of social housing arrangement.

The mentioned projects include: Yen Thang Lake complex tourist center and 54-hole golf course; ecological tourist area of Dong Thai Lake, eastern bus station in Ninh Binh city; high-end wood processing factory in Xich Tho commune, Nho Quan district; Binh Minh residential area, Nho Quan district; Gian Khau industrial zone; new urban area in the north of Ninh Binh city and Hoa Lu district.

In addition, 4/18 projects violated the construction order, such as: restaurant and production facilities serving tourism in Gia Van commune, Gia Vien district; Yen Thang Lake complex tourist center and 54-hole golf course; Tan An commercial and service center; Ha Thanh integrated business service area (Phuoc Loc).

Furthermore, 7/18 projects are delayed, including: Dong Thai Lake ecological tourist area; high-end wood processing factory in Xich Tho commune; restaurant and production facilities serving tourism in Gia Van commune, Gia Vien district; Ha Thanh integrated business service area; Binh Minh residential area (Nho Quan district); Tan An commercial and service center; new urban area in the north of Ninh Binh city and Hoa Lu district.

Moreover, the auctioning of assets and land use rights for 62 locations has been conducted without a resettlement plan, which is not in accordance with Government Decree No. 167/2017 and the Prime Minister’s decisions (No. 09/2007, 10/2008).

The Government Inspectorate found that Ninh Binh auctioned land use rights in 425 residential areas, rural residential areas with a total area of over 700 hectares, but before August 2018, the provincial People’s Committee did not approve the program and plan for housing development in accordance with the Government’s regulations for implementing investment in residential areas and rural residential areas.

The conclusion stated that by the end of 2022, the total area of public land in Ninh Binh was about 5,500 hectares, mainly leased to households and individuals for agricultural production without auctioning, with lease terms ranging from 1 to 5 years. However, the rent prices are not consistent as they are decided by the communes.

The optimization of land consolidation and conversion of agricultural land has not been carried out effectively, while large areas of public land are dispersed, small, and used inefficiently. There are 320 cases where households and individuals have unlawfully converted agricultural land to residential land, production land, and non-agricultural business land, totaling 91.3 hectares; 197 cases of encroachment on public land, unauthorized construction, ongoing without being handled.

Transfer to investigative agencies if violations occur

The Government Inspectorate requested the provincial People’s Committee of Ninh Binh to inspect, review, and handle any violations according to regulations. This includes the transfer and assignment of agricultural land of 81 projects without the approval documents from competent state authorities or without meeting the requirements according to regulations; review and handle violations of procedures and approval decisions for investment orientations in the ecological tourist area and Golden Cuc Phuong villas, Nho Quan district.

The Government Inspectorate also requested the provincial People’s Committee to organize a review of responsibility and strictly handle it according to delegated authority or recommend handling by the competent authorities; at the same time, direct the heads of agencies, units, localities, and individuals to review responsibility and clarify the responsibilities of each organization and individual related to the mentioned limitations, deficiencies, and violations in the conclusion.

The provincial People’s Committee urgently directed and implemented the conclusions and recommendations of the inspection; take corrective measures, overcome, and handle constraints, deficiencies, and violations in implementing laws on inspection, citizen reception, settlement of complaints, denunciations, and anti-corruption; manage and use land, grant permits for exploitation of land and stone mines for construction materials, planning work, and implementation of planning mentioned in the conclusion.

During the implementation of the inspection conclusion, if any loss of the State budget is discovered and there are signs of violating criminal laws, transfer to investigative agencies for strict handling according to the law.
