Inadequate Planning
The Government Inspectorate issued conclusions on the inspection of land management and use activities in accordance with the spirit of Resolution No. 73/NQ-CP and Resolution No. 116/NQ-CP of the Government; the planning work and implementation of planning by the Hung Yen Provincial People’s Committee. Besides the achieved results, the Government Inspectorate (GI) pointed out some violations.
Specifically, the GI concluded that the People’s Committee of Hung Yen province is still limited in the inspection and review of land use by businesses after equitization; so far, they have not completed the procedures for land transfer, land lease, and issuance of land use right certificates.
Regarding planning work and implementation of construction planning, the Hung Yen Provincial People’s Committee issued regulations on decentralizing management and assigning tasks in the field of construction planning, architecture that did not comply with regulations; construction work, compiling a list of planning projects for capital allocation in planning work was not complete…
In addition, the urban development program in the province has some guidelines for implementation that are not complete and not suitable. The Provincial People’s Committee has recognized 16 areas in communes that meet the standard for Grade V Urban Areas according to the plan to implement the provincial urban development program of Hung Yen, phase until 2020; however, these 16 areas have not had approved urban planning.
Regarding the issuance of land use right certificates for households and individuals in urban areas and some urban, residential areas, the rate is low, in which the cause is that land users do not understand and implement their rights and obligations in declaring and registering the issuance of land use right certificates.
19 projects with deficiencies and violations
Notably, the GI’s conclusion clearly states that 19 land use projects in the province during the implementation process have violations. Among them, 7 projects have restrictions and shortcomings in construction planning work such as: Timing of investment decision, approval of detailed construction planning, implementation land location of the project is not suitable and consistent with the overall planning; detailed construction planning for projects at a scale of 1/500 still have some criteria that do not meet standards.
Most of these projects also have restrictions and shortcomings in determining land use fees; slow progress in implementation; some investors do not comply with regulations on conditions for transfer of houses and land in areas requiring construction of residential houses before transferring land use rights in the form of sub-division, plot sale; construction without permits or not built according to approved plans…
To address the above limitations and shortcomings, the GI believes that the responsibility lies with the Chairman, Vice-Chairman of the Provincial People’s Committee in charge of related periods; the Directors, Deputy Directors in charge of the departments and branches: Department of Natural Resources and Environment, Department of Construction, Department of Finance, Department of Planning and Investment, and Provincial Tax Department in related periods; the Chairmen, Vice-Chairmen of People’s Committees of districts, cities, and towns in the respective periods and investors of the projects…
The GI has recommended the Prime Minister to assign the Hung Yen Provincial People’s Committee to urgently review and complete the land use plan, land lease, and issuance of land use right certificates… At the same time, together with the Departments and agencies, they need to review, learn lessons, and rectify in organizing the deployment and advising on the implementation of Resolution No. 73/NQ-CP and Resolution No. 116/NQ-CP of the Government.
Regarding the 19 projects directly inspected and found violations, such as the Mixed-use High-rise Building and Residential Area for Sale project; the Infrastructure Construction and Business project of Minh Quang Industrial Zone; the Commercial Center and Villa project of Pho Hien; the Residential and Service Area of Ngoi Industrial Zone; the Commercial Center and Residential Area of Nhu Quynh; the project to invest in the construction of residential areas, Mỹ Hào bus terminal and Bình Minh Hung Yen clean water plant; the project to build residential areas for sale… The GI recommended the Prime Minister to assign the Provincial People’s Committee of Hung Yen to inspect and re-determine the land use fees for land transfer and change of land use purposes. It must ensure accuracy, sufficiency, and not lose any State budget.
For the two social housing and commercial housing projects of Lac Hong Phuc; the project to invest in the construction of residential areas, My Hao bus terminal and Binh Minh Hung Yen clean water plant, the GI recommended that the Prime Minister assign the Provincial People’s Committee to direct the Department of Finance to determine accurately the protection and development amounts for rice cultivation land, supplement the budget with more than VND 3.9 billion.
