The Government Inspectorate (GI) has issued an announcement on the inspection conclusions regarding land management, land use, planning, and implementation of planning in Hung Yen province from 2011 to 2022.
Through the inspection of 19 land use projects, the GI has discovered a series of restrictions, deficiencies, and violations.
Specifically, it has been found that 4 projects were approved with investors not going through the legal process of investor selection through bidding for housing projects.
Specifically, these include: the project of constructing technical infrastructure for Zone A – Northern Urban Area on National Highway 5 in Pho Noi Urban Area, Hoang Anh Residential Area, the project of Hung Vuong Hung Yen Investment Development Joint Stock Company, and the project of constructing commercial and urban residential areas.

In the project of constructing technical infrastructure for Zone A – Northern Urban Area on National Highway 5 in Pho Noi Urban Area, the GI has recommended that the Prime Minister direct the Hung Yen Provincial People’s Committee to revoke document No. 1488 issued in 2016 regarding the continuation of assigning Hoa Phat Urban Development and Construction Joint Stock Company (Hoa Phat Company) as the investor.
According to the inspection, at this time, The Housing Law 2014 and Government Decree No. 99 in 2015 do not have regulations on the transfer of implementation of projects using land funds for construction of infrastructure.
In addition to recommending the revocation of the document, the GI also recommended that the Prime Minister direct the Hung Yen Provincial People’s Committee to review the legal documents and conduct auctioning and selection of a new investor for the project.
“During the implementation process, if any violations of criminal laws are discovered, or if the selection of an investor through bidding has not been carried out by June 30, 2025, the matter shall be transferred to the investigative agency for prosecution as prescribed” – GI stated.
Regarding the project, according to the reporter’s research, in 2004, Hoa Phat Urban Development and Construction Joint Stock Company (Hoa Phat Company) was selected by the Hung Yen Provincial People’s Committee as the investor for the project.
One year later, the Hung Yen Provincial People’s Committee issued a decision approving the project with a land use scale of 300 hectares and an estimated total investment of over 2,700 billion VND.
In 2010, the Hung Yen Provincial People’s Committee approved a detailed construction plan with a scale of 1/500.
On July 14, 2016, the Hung Yen Provincial People’s Committee issued document No. 1488 continuing to assign Hoa Phat Company as the investor to implement the project through the mechanism of land allocation with land use fees.
Also in 2016, the provincial government issued a decision approving an adjustment to the detailed construction plan with a scale of 1/500 for Zone A of the Northern Urban Area on National Highway 5 in Pho Noi Urban Area.

In early 2019, the Ministry of Construction responded to Hoa Phat Company’s request for implementation of the project. Accordingly, the project needs to adjust some contents, with a total investment of about 3,500 billion VND, and a land use scale of about 262 hectares (The state allocates land with land use fees, not through auctions or transfers of land use rights or assets attached to land).
