During inspection of 19 land projects in Hung Yen province, the Government Inspectorate discovered a series of restrictions, deficiencies, and violations. Among them is the infrastructure investment project for the technical zone A of the northern urban area of QL5, which is part of the Pho Noi urban area. The project is invested by Hoa Phat Urban Development and Construction Joint Stock Company (Hoa Phat Company).

In the inspection conclusion, it is stated that the infrastructure investment project for the technical zone A of the northern urban area of QL5 is one of the four projects selected by the Provincial People’s Committee of Hung Yen to be executed without using a bidding process to select the investor.

In addition, the inspection agency pointed out that this project was allocated land in 2018, but until the end of the inspection (May 2023), the land price has not been approved.

Based on the inspection results, the Government Inspectorate recommends the Prime Minister to instruct the People’s Committee of the province to revoke Decision No. 1488/UBND-KT1 dated July 14, 2016, regarding continuing to assign Hoa Phat Urban Development and Construction Joint Stock Company as the investor for the project. This is because at the time, the Housing Law 2014 and Decree No. 99/2015/NĐ-CP dated October 20, 2015 of the Government did not have regulations for transferring implementation of the project through the use of land funds to generate infrastructure construction capital.

At the same time, the functional agencies are instructed to review the legal documents to re-bid for selecting the investor for the land-use project in accordance with the law.

“During the implementation, if any violations of criminal law are detected or by June 30, 2025, the investor selection bidding process is not carried out, then the case will be transferred to the investigating agency for processing in accordance with regulations,” the inspection conclusion specifies.

The Government Inspectorate also suggests that the Provincial People’s Committee of Hung Yen direct the Department of Natural Resources and Environment to promptly determine the land-use fee for the infrastructure investment project in zone A of QL5, after re-bidding to select the investor in accordance with the law; ensure accuracy, sufficiency, and no loss.

It is known that in 2004, Hoa Phat Company was selected by the Provincial People’s Committee of Hung Yen as the investor for the Northern QL5 urban area project, which is part of the Pho Noi urban area (My Hao, Hung Yen).

Subsequently, the Provincial People’s Committee of Hung Yen issued Decision No. 358/QD-UB dated February 25, 2005, approving the project with a land-use scale of 300 hectares and a total estimated investment of 2,710 billion VND; By 2010, the detailed construction planning at a scale of 1/500 of zone A of the Northern QL5 urban area was approved.

On July 14, 2016, the Provincial People’s Committee of Hung Yen issued document No. 1488/UBND-KT1 continuing to assign the Company as the investor for the project using the mechanism of land allocation with land-use fee.

In 2016, the Provincial People’s Committee of Hung Yen also issued a decision approving the adjustment of the detailed construction planning at a scale of 1/500 of zone A of the Northern QL5 urban area project under Pho Noi urban area.

According to our observation, the project is currently being fenced, and the project’s technical infrastructure is still messy.

Some internal items of the project have been completed but have been abandoned for many years.

Inside the project area, the developer is planting trees.

Meanwhile, many areas of the project are left vacant with overgrown grass.

In the project area, security guards prevent unauthorized access.

The A zone of the QL5 urban area project is located in a favorable geographical position, close to QL5 road connecting Hanoi, Hung Yen, Hai Phong, and Quang Ninh…

The project is also located near Pho Noi General Hospital in Hung Yen.
