Land is a resource that needs to be tightly managed and efficiently used to avoid negative consequences leading to the loss of state assets and the risk of corruption in land and public asset management.

Recently, serious violations in the “transformation of public land” into private land at 152 Tran Phu (District 5, Ho Chi Minh City) have been clearly pointed out by many functional agencies. The Department of Natural Resources and Environment of Ho Chi Minh City has issued a notice to revoke and cancel the land use right certificate for the land.

Regarding the “golden land” 152 Tran Phu, the conclusion of the functional agencies states that the responsibilities for the violations and shortcomings belong to: the Board of Members, the Chairman of the Board of Members, the General Director, the Leadership Board of Vinataba, Saigon Tobacco Company Limited.

However, Vinataba has not yet announced and publicly disclosed the results of assessing responsibilities of individuals and organizations involved in the series of legal violations at 152 Tran Phu land.

Up to now, the management agency of Vinataba – the State Capital Management Committee in enterprises has not made any official announcement related to this issue.

The State Capital Management Committee in enterprises has reappointed Mr. Ho Le Nghia as the Chairman of the Board of Members of Vinataba (8/2023). It is known that Mr. Nghia is on the list of individuals required to assess responsibilities for serious legal violations mentioned.

The causes of loss, waste, and negative consequences from public land in corporations, state-owned enterprises have been pointed out many times, but so far, they have not been thoroughly resolved.

The land resource of the state has been exploited and abused when it is misused or sold at a lower price than the market price, causing significant losses to the state budget.

The question is, besides holding individuals accountable, how will the lost money from such lands be recovered when hundreds of trillions of dong have been embezzled.

Regarding the accountability for the violation of turning “public land into private land”, on January 7, 2024, the Ministry of Public Security announced that Dang Ngoc Cam and Nguyen Quoc Khanh, both members of the Board of Members of the Vietnam Tea Corporation, have been arrested for signing resolutions of the Board of Members of the Vietnam Tea Corporation to agree to contribute capital and divest capital in using the land at 225 Nam Ky Khoi Nghia (District 3, Ho Chi Minh City) without public auction according to regulations, causing damage to state assets.

Previously, regarding this violation, the Investigation Police Agency of the Ministry of Public Security also arrested Nguyen Thien Toan- former General Director, in charge of the Board of Members of the Vietnam Tea Corporation.
