Proposed regulations on the responsibilities of organizing the real estate broker examination and certification are as follows:
The Ministry of Construction organizes the broker examination and grants the broker certification according to the provisions of this Decree and other relevant regulations.
The planned examination schedule is announced by the Ministry of Construction to the Departments of Construction and is also posted on the Ministry of Construction’s Electronic Information Portal no later than 2 months before the examination date. The Department of Construction is responsible for announcing to those who wish to submit application documents to participate in the examination as stipulated and in accordance with the Ministry of Construction’s planned schedule; making a list and submitting a request to the Ministry of Construction for participation in the examination for cases that meet the requirements, along with the application documents of the proposed individuals.
Method of organizing the broker examination and certification
The Ministry of Construction assigns or authorizes one or several of the following units to organize the examination (the examination organizer):
The Department of Housing and Real Estate Market Management; Training facilities that have sufficient conditions for the business of training and enhancing knowledge of real estate broker profession, operating real estate trading floors as prescribed in Article 69 of the 2023 Real Estate Business Law; Vietnam Real Estate Association; Real Estate Associations of provinces and centrally-run cities; Vietnam Real Estate Brokers Association.
Examination fees: Examination candidates must pay examination fees to the examination organizer. The examination fee level is determined by the Ministry of Construction for each examination depending on the number of candidates registered for the examination to cover the costs of organizing the examination, based on the proposal of the Chairman of the Examination Council.
The examination organizer uses the examination fees to cover the expenses of the examination organization, remuneration for the members of the Examination Council. Settlement of examination fees must be approved by the Chairman of the Examination Council.
Candidates for the examination must meet the following conditions to be eligible to participate in the examination:
Having full civil capacity, not being in the state of being pursued for criminal liability or serving a sentence of imprisonment. Having graduated from high school or higher. Having submitted application documents and examination fees to the examination organizer as prescribed. Real estate broker certification
The examination candidates who achieve the examination results as prescribed and possess sufficient documents will be awarded a certificate.
Procedure for issuing certificates: The Chairman of the Examination Council reports to the leaders of the Ministry of Construction on the examination process and approves the examination results according to the proposal of the examination organizer.
Based on the report of the Chairman of the Examination Council and the approved examination results, the leaders of the Ministry of Construction approve the list of individuals to be granted certificates.
Based on the decision to approve the list of individuals to be granted certificates, the examination organizer is responsible for sending a photocopy of the examination paper and the dossier of those individuals to the Ministry of Construction for certificate issuance.
Within a period of 10 working days from the date of receipt of sufficient valid documents, the Ministry of Construction organizes the printing and signing of the certificates.
The Ministry of Construction is responsible for keeping the dossier of the person granted the certificate according to regulations.
