The Bắc Ninh province inspectorate has just issued Conclusions No. 11 on the inspection of the investment project for the construction and business of the VSIP Bắc Ninh urban and service area (Phù Chẩn Ward, Từ Sơn City), implemented by Đệ Tam Joint Stock Company as the Investor. Accordingly, the provincial inspection agency has pointed out many existing violations in the implementation process of the project.
According to Decision No. 18 dated January 13, 2022, approving the adjustment of the investment policy and approving the investor while determining the progress of completing construction works on land in 2021. However, the project has not been completed and handed over for use. The investor has also not adjusted the project’s investment progress as required by regulations.
In particular, VSIP Bắc Ninh Limited Liability Company transferred a part of the VSIP Bắc Ninh urban and service area project to Đệ Tam Joint Stock Company without the consent of the Chairman of the People’s Committee of Bắc Ninh province. In addition, VSIP Bắc Ninh Limited Liability Company transferred 1,000 m2 of land to Đệ Tam Joint Stock Company before the People’s Committee of Bắc Ninh province issued a decision to recover land and transfer land in accordance with the Land Law 2013.
At the same time, the Bắc Ninh province inspectorate also discovered that some construction acceptance records were not properly filled with the names of the participants, and the signatures of the participants were not clear. “It is worth noting that all infrastructure acceptance records mistakenly wrote the actual acceptance address of the project in VSIP Bắc Ninh Urban Area, but the construction acceptance records were written in Nhơn Trạch. The supervising unit did not require the establishment and approval of labor safety and environmental protection measures for items during the construction process; The basic construction part has been completed, but the completion drawings for the rough construction and exterior finishing have not been created,” the Bắc Ninh province inspectorate pointed out.
In particular, the inspection team recalculated the financial documents of the project construction design drawing provided by the Investor, with a total discrepancy of more than 10 billion VND.
In terms of real estate business conditions, the inspection conclusion determined that in 2019, Đệ Tam Joint Stock Company signed 27 preliminary contracts under the form of capital mobilization to prioritize registration for land plots in the project for the mobilized party, without the complete notice of capital mobilization conditions from the Department of Construction, violating the provisions of the Housing Law.
It is known that the part of the project in the VSIP Bắc Ninh urban and service area, which Đệ Tam Joint Stock Company received from VSIP Bắc Ninh Limited Liability Company, is named Garden House VSIP Bắc Ninh project with about 160 villas.
According to the schedule, the project was supposed to complete the construction works on land in 2021 for use. However, according to the observation of the reporter, although the project has completed the rough part for many years, over a hundred villas of Đệ Tam Joint Stock Company are abandoned and unoccupied.

Although the project is incomplete and not yet officially accepted, the investor has allowed some households to move in, posing many safety risks.
Speaking with the reporter, the leader of the Department of Construction of Bắc Ninh province said that regarding the handling of violations by Đệ Tam Joint Stock Company in signing 27 contracts for capital mobilization without complete notice of capital mobilization conditions, the Department has worked with the investor and requested submission of documents for handling according to regulations.
Meanwhile, the representative of the investor stated that they are coordinating with the functional agencies of Bắc Ninh province to address the existing violations identified by the provincial inspectorate.
The Bắc Ninh province inspectorate also pointed out a series of existing, limited, and deficient issues of Bình Dương Trading and Investment Joint Stock Company (Bình Dương Company) during the process of receiving transfer and developing the project in the VSIP Bắc Ninh urban and service area, such as: Transferring land in violation of regulations, not performing the examination of standard house construction estimates, not creating material estimates, and not applying suitable measures; The project has not been completed and handed over for use according to the approved schedule.
According to the inspection agency, Bình Dương Company has been guaranteed financial obligations by the Vietnam Investment and Development Joint Stock Bank – Hanoi branch before the company even formed houses for sale in the future for 91 transferred lots in 2023. Financial obligation guarantees are still incomplete for the 155 transferred lots in 2022.
According to the observation of the reporter, adjacent to the project of Đệ Tam Joint Stock Company, the project of Bình Dương Company with 246 villas and townhouses has also just completed the rough part, while other items are still in disarray, unfinished, and wasted.
