More than 62 hectares of land in Nha Trang airport area have been given to Phuc Son Group Joint Stock Company with many violations.
Urgently work with Phuc Son Group to inspect and review projects
Phuc Son Group is a company owned by Nguyen Van Hau, also known as Hau “pháo”, who is the Chairman of the Board of Directors and has been arrested by the Ministry of Public Security for the crime of “Serious violations of accounting regulations” at the end of February 2024 along with 5 accomplices.
In this document, the People’s Committee of Khanh Hoa province assigned the Department of Planning and Investment to be the main unit, coordinating with the Departments of Transport, Natural Resources and Environment, Construction, Finance, Nha Trang City, Dien Khanh District, Van Phong Economic Zone Management Board, Investment Project Management Board for construction of transportation works, Agricultural and rural development investment projects management board, and Khanh Hoa provincial project development management board and other related agencies and units, to urgently work with Phuc Son JSC to inspect and review projects, works invested or constructed by this company in Khanh Hoa province.
Specifically, it is necessary to determine whether Phuc Son JSC continues to invest, construct unfinished projects, current difficulties and propose solutions, submitting to the Khanh Hoa provincial People’s Committee before March 30, 2024.
Previously, on February 21 and March 5, the Khanh Hoa Provincial Land Fund Development Center and Nha Trang City People’s Committee had a written report to the Khanh Hoa provincial People’s Committee on the difficulties in land recovery for defense units affected by the project connecting Nha Trang airport and the difficulties in compensation, site clearance for 3 transportation projects with Phuc Son JSC according to the form of build – transfer (BT)
On February 27, the Khanh Hoa provincial People’s Committee also directed the departments, committees, branches and localities mentioned above, along with the Tax Department and the Inspectorate of Khanh Hoa province to provide the entire information, documents and materials related to the process of approving investment decisions; selecting investors; implementing investment, construction; declaration and implementation of tax obligations; inspection, examination… at projects, works invested or constructed by Phuc Son JSC and related businesses in the province of Khanh Hoa at the request of the Criminal Investigative Agency of the Ministry of Public Security, serving the verification and investigation of signs of legal violations in the fields of tax, accounting, investment, construction of projects, works invested or constructed by Phuc Son JSC and related businesses.
Khanh Hoa has 2 “suspended projects” by Phuc Son Group
Over the past 10 years, there have been two “suspended projects” in Khanh Hoa province by Phuc Son JSC that have caused many difficulties for people in the project area, causing public outrage.
They are Phuc Khanh 1 urban area with an area of nearly 14 hectares in Vinh Trung commune, Nha Trang City and Phuc Khanh 2 urban area with an area of over 49 hectares in Dien An commune, Dien Khanh district.
Both projects were approved by the People’s Committee of Khanh Hoa province with a 1/500 plan since 2014, Phuc Son JSC mobilized personnel, technical equipment, mechanical vehicles to organize ground leveling, compacting, and constructing several items… and then left unfinished until now.
Currently, only a few asphalt, concrete roads and border fences made of zinc-coated steel have been constructed, but no technical infrastructure items have been built inside, while legal procedures for compensation and site clearance at the two projects have not been completed.
Phuc Son Group’s 3 BOT projects as investor have not been completed as committed
In a related development, in October 2016, the People’s Committee of Khanh Hoa province transferred and leased out more than 62 hectares of land in the Nha Trang airport area for Phuc Son JSC to implement the Urban Center project, Commercial, Services, Finance, and Tourism in Nha Trang.
Alongside with that, Khanh Hoa province has used a land fund of 29.14 hectares of land in the aforementioned Urban Center project to pay off the capital for Phuc Son JSC to implement 3 BOT projects. Including the construction of Ngoc Hoi traffic intersection; construction of the belt road 2 connecting to Ngoc Hoi traffic intersection and construction of road links – traffic intersections connecting to Nha Trang airport with a total investment capital of over 3,261 billion VND.
Despite multiple extensions, so far, the BOT transport projects invested by Phuc Son JSC have not been completed as committed, while this enterprise has received more than 62 hectares of land in the Nha Trang airport area, dividing thousands of lots for signing “investment contribution contracts” with many people.
Phuc Son Group has not paid more than VND 11,994 billion to the state budget
Notification No. 1029/TB-TTCP dated June 30, 2021 of the Government Inspectorate’s Conclusion on the inspection of compliance with policies and laws related to land settlement BT projects in the Nha Trang airport area, also pointed out a series of violations by localities and businesses.
Implementing the request of the competent authorities, since August 2022, Khanh Hoa provincial People’s Committee has issued a document requesting Phuc Son JSC to pay to the state budget more than VND 11,994 billion for the value of land use of the remaining more than 42.7 hectares in the Urban Center, Commercial, Services, Finance and Tourism project in Nha Trang.
However, until now, Phuc Son JSC has not implemented this requirement.
The defendants were arrested and temporarily detained in the Phuc Son Group case.
Phuc Son Group case: 15 defendants have been prosecuted and temporarily detained
In relation to the case at Phuc Son Group, up to the present time, the Ministry of Public Security has prosecuted and temporarily detained a total of 15 defendants, including 1 Secretary of the Provincial Party Committee, Chairman of the Provincial People’s Council; 2 Chairmen of the Provincial People’s Committee; 1 former Chairman of the Provincial People’s Committee; along with a series of leaders of Phuc Son Group and related persons,… The Criminal Investigative Agency of the Ministry of Public Security called on the parties involved in this case to promptly surrender, denounce the criminals and rectify the consequences to enjoy the leniency policy of the law.
Specifically, the Criminal Investigative Agency of the Ministry of Public Security has prosecuted and temporarily detained 15 defendants, including:
– Ms. Hoang Thi Thuy Lan, Secretary of the Provincial Party Committee, Chairman of the Provincial People’s Council, Head of the Delegation of National Assembly Deputies of Vinh Phuc province.
– Mr. Le Duy Thanh, Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People’s Committee, Deputy of the Provincial People’s Council of Vinh Phuc province.
– Mr. Dang Van Minh, Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People’s Committee of Quang Ngai province, Deputy of the Provincial People’s Council of Quang Ngai province, former Director of the Department of Transport of Quang Ngai province.
– Mr. Cao Khoa, former Chairman of the Provincial People’s Committee of Quang Ngai province.
– Mr. Ha Hoang Viet Phuong, Director of Dung Quat Economic Zone Management Board and industrial parks, former Deputy Director of the Department of Transport of Quang Ngai province.
– Ms. Pham Ngoc Thuy, Deputy Director of the Department of Transport, former Head of the Technical & Quality Department of the Department of Transport of Quang Ngai province.
– Mr. Le Quoc Dat, Director of the Investment Project Management Board for construction of transportation works, former Head of the Investment Management Department of the Department of Transport of Quang Ngai province.
– Mr. Pham Ngoc Cuong, Deputy General Director of Phuc Son Group JSC.
– Mr. Dang Trung Hoanh, Chief of the Party Committee’s Office of Mang Thit district, Vinh Long province.
– Mr. Nguyen Van Hau (commonly known as “Hau Phao”), Chairman of the Board of Directors of Phuc Son JSC.
– Ms. Nguyen Thi Hang, Deputy General Director of Phuc Son JSC.
– Ms. Do Thi Mai, Chief Accountant of Phuc Son JSC.
– Ms. Hoang Thi Tuyet Hanh, Accountant of Phuc Son JSC.
– Mr. Tran Huu Dinh, Director of Nama Group Investment Joint Stock Company.
– Mr. Nguyen Hong Son, freelance worker.
The Ministry of Public Security continues to investigate and expand the case; calling on the parties involved to promptly surrender, denounce the criminals
The Information Portal of the Ministry of Public Security stated that currently, the Criminal Investigative Agency of the Ministry of Public Security is consolidating documents and evidence of violations by the accused who have been charged in this case.
At the same time, the Criminal Investigative Agency of the Ministry of Public Security continues to expand the investigation of the case, clarify other violations by Phuc Son Group in localities and related units, apply measures according to the law to completely recover assets for the State.
The Criminal Investigative Agency of the Ministry of Public Security called on the parties involved in this case to promptly surrender, denounce the criminals and rectify the consequences to enjoy the leniency policy of the law.
Nguyen Van Hau along with the defendants have been prosecuted and temporarily detained.
