This is carried out in accordance with Plan No. 5737/KH-TTTTP dated November 14, 2023 by the City Inspection Department, regarding the implementation of Plan No. 320/KH-UBND dated October 5, 2023 by the Hanoi People’s Committee concerning the implementation of the Central Steering Committee’s conclusions on anti-corruption and negative behaviors in the inspection of leadership, direction, organization of the detection, transfer, reception, handling of denunciations, crime reports, recommendations for initiating investigations into cases with signs of corruption, economic offenses, negative behaviors

Among them, there is a review of compliance with the regulations on management, use of state-owned assets, and land management in the Park City project, which is invested by VIDC

On January 9, 2024, the Hanoi City Inspection Department issued Document No. 148/TTTP-P6 and No. 148/TTTP-P6, requesting the Department of Finance and the Department of Construction to report in writing and provide the Park City project documents, no later than January 16, 2024

However, as of February 5, 2024, the Hanoi City Inspection Department has not yet received reports and documents from the Department of Finance and the Department of Construction. Therefore, the Hanoi City Inspection Department continues to issue Document No. 594/TTTP-P6, urging the Department of Construction and the Department of Finance to promptly report and provide documents related to the project

It is known that the Park City project is located within the administrative boundaries of La Khe and Yen Nghia wards, belonging to Ha Dong district, Hanoi; formerly Yen Nghia commune and La Khe ward, belonging to Ha Dong district, Hanoi province (former)

The project covers an area of about 77.4 hectares, with a planned population of about 23,000 people

In 2015, the Hanoi People’s Committee issued Decision No. 6077/QD-UBND approving the adjustment of the detailed overall planning of the Park City project. It is noteworthy that the 1/500-scale planning of the Park City project does not include a 20% land fund for social housing construction

It is known that the Park City project is also in the process of redefining financial obligations

Previously, in July 2008, the Hanoi Provincial People’s Committee issued Decision No. 2926/QD-UBND approving the land use fee for the Park City project. However, until December 2016, the Hanoi Department of Natural Resources and Environment transferred the project land boundaries to VIDC

The Department of Natural Resources and Environment stated that the determination of financial obligations in July 2008 while the project land has not yet been cleared is not in compliance with regulations

The Department of Natural Resources and Environment cites 3 legal bases to determine financial obligations for the Park City project. They are Section B, Article 1, Article 4 of Decree No. 84/2007/ND-CP dated May 25, 2007 of the Government; Section B, Article 1, Article 20 of Decree No. 45/2014/ND-CP dated May 15, 2014 of the Government and Section 3, Article 108 of the Land Law 2013

Therefore, the Department of Natural Resources and Environment proposes that the Hanoi People’s Committee allows the determination of additional financial obligations (if any) due to adjustment of planning; review and determine land use fee at the actual land transfer time in December 2016 – the time of completion of land clearance and receipt of land transfer outside the actual site in accordance with regulations

According to records, apart from the areas for villas, townhouses, and apartments, some areas of the Park City project are still surrounded by fences and left vacant
