Late afternoon of March 18, responding to VTC News reporters, lawyer Ta Anh Tuan, Director of Emme Law Limited Liability Company (Hanoi Law Association) – representative of Mr. P.H.A (Quang Ninh), informed that on the morning of March 19, Mr. Tuan is expected to work with the Export Import Bank of Vietnam (Eximbank) Quang Ninh branch regarding the case where Mr. H.A. received a notice from Eximbank to recover bad debts of nearly 8.5 million VND spent through credit card since 2013, with accumulated interest now amounting to 8.84 billion VND.
Last week, Mr. Tuan stated that he has gathered information and documents from Mr. H.A., but they are not complete and comprehensive enough. “We will have to meet with Eximbank to obtain multidimensional and comprehensive information. This week, I will complete all necessary procedures in accordance with regulations. Next week, I will work with Eximbank,” he said.
According to information from Eximbank, Mr. H.A. opened a Master Card at Eximbank Quang Ninh branch on March 23, 2013 with a credit limit of 10 million VND.
The customer then made 2 payment transactions on April 23, 2013 and July 26, 2013 at an accepting point. Since September 14, 2013, the aforementioned credit card debt has become bad debt, with overdue period of nearly 11 years. Immediately after that, the bank has taken multiple steps to recover Mr. H.A.’s debt.
“This is an overdue debt that has lasted for nearly 11 years. The bank has notified and worked directly with the customer on many occasions. However, the customer still does not have a plan to deal with the debt,” Eximbank informed.
The bank reaffirmed that sending debt obligation notices to customers is a normal business activity during the process of debt management and recovery. Up to now, the bank has not received any payments from the customer.
According to Eximbank, the interest and fees calculation method in the above-mentioned debt is “completely in accordance with the agreement between Eximbank and the customer based on the card application file dated March 15, 2013, with the customer’s full signature. The regulations on fees and interest are clearly stated in the issuing fee and card usage fee schedule, which has also been publicly posted on Eximbank’s website.”
Eximbank emphasized that it is currently working and coordinating with the customer to develop a debt solution plan.
However, the customer being victimized claims that he did not spend 8.5 million VND on the credit card, and the bank also did not send an early notice when his debt turned bad. In March 2013, the customer asked an employee working at Eximbank Quang Ninh branch to make a credit card, but in reality, he did not receive this credit card.
During the last meeting at his home with the bank representative around mid-2022, Mr. A. also requested clarification on the signs of customer fraud committed by that employee.
Analyzing the initial details of this situation, lawyer Ta Anh Tuan stated that if Mr. H.A.’s account is accurate, this case is facing issues regarding the card issuing process, especially the card delivery step to customers.
“It is highly possible that the customer overlooked to carefully check the card. In Mr. H.A.’s case, when he received it, it was not a credit card, but a regular ATM card. In principle, when receiving the card, Mr. H.A. himself needed to check it thoroughly, but why did he not check, what is the real situation, must be clarified,” Mr. Tuan said.
On March 14, the State Bank of Vietnam Quang Ninh branch issued a document requiring the Eximbank headquarters in Ho Chi Minh City and Eximbank Quang Ninh branch to verify and clarify the information related to this case and notify the media agencies.
According to VTC News sources on the morning of March 19, the State Bank of Vietnam Quang Ninh branch has received and is reviewing the detailed report on Eximbank’s case.
