Mr. Tran Qui Thanh and his Two Daughters Appear in Court

Accused of appropriating over VND 1.04 trillion from individuals and businesses, Tran Quy Thanh and his daughter have appeared in court.

On April 23, 2023, the People’s Court of Ho Chi Minh City opened a trial for the case of “Breach of Trust and Asset Misappropriation,” which was carried out by the defendant Tran Qui Thanh, (former Director of Tan Hiep Phat Trading and Service Company Limited), and his two daughters, Tran Uyen Phuong and Tran Ngoc Bich.

The trial is scheduled to take place from April 23-25, with Judge Huynh Minh Truc presiding.

Representing the People’s Procuracy of Ho Chi Minh City, in accordance with the assignment of the Supreme People’s Procuracy, are Mr. Vu Tat Ba, Mr. Pham Van Hien, and Mr. Mai Hoan Dong.

Four lawyers are involved in the defense of the defendants: lawyer Truong Thi Minh Tho, Kieu Vu Thuy Uyen, Truong Thanh Duc, and lawyer Nguyen Truong Son.

In this case, Ms. Dang Thi Kim Oanh, Mr. Nguyen Van Chung, Mr. Lam Son Hoang, and Mr. Nguyen Huy Dong are identified as victims.

Parties with rights and obligations related to the case include Kim Oanh Dong Nai Investment and Development Joint Stock Company and 34 other individuals.

According to the prosecution, from 2019 to 2020, through a number of brokers, Mr. Tran Qui Thanh and his two daughters lent money to several businesses and individuals. The family of Mr. Tran Qui Thanh and the borrowers did not establish loan agreements with asset collateral but forced the businesses and individuals borrowing money to sign contracts transferring projects, shares in projects, and real estate, with values much lower than the actual value of the assets.

To legitimize the lending, the family of Mr. Tran Qui Thanh signed “repurchase commitments,” with loan interest legalized through receipts for deposits to repurchase projects and real estate, promising to pay the principal and interest in full and return the assets.

Under Mr. Thanh’s direction, his two daughters, Tran Uyen Phuong and Tran Ngoc Bich, received the asset transfers. Subsequently, Mr. Thanh’s group quickly completed the procedures to change the names to take control of and dispose of the assets.

When the borrowers fulfilled their obligations to pay the principal and interest as agreed, the family of Mr. Tran Qui Thanh gave unreasonable excuses for refusing to pay, did not return the assets, arguing that the asset owners had violated the terms of the contract and had therefore lost their right to repurchase, or created other excuses such as forcing the asset owners to pay more money, not allowing them to pay in installments but demanding payment of the entire principal. Ultimately, the group led by Mr. Tran Qui Thanh aimed to intentionally seize the victims’ assets.

According to the indictment, from January 1, 2019, to November 2020, Mr. Tran Qui Thanh and his accomplices committed four acts of “breach of trust and asset misappropriation” from four victims.

Specifically, the assets include: two Minh Thanh and Nhon Thanh projects in Dong Nai belonging to Ms. Dang Thi Kim Oanh (Chairman of the Board of Directors of Kim Oanh Real Estate Group); 29 plots of land separated from plot 452 in Binh Tan District belonging to Mr. Nguyen Van Chung, 4 plots of land in Thu Duc City belonging to Mr. Lam Son Hoang, and 2 plots of land in Binh Tan District belonging to Mr. Nguyen Huy Dong.

The total value of the assets, as assessed by the prosecuting agency, is over 1,040 billion VND.
