Demand for Investigation of Ba Ria – Vung Tau Town Chairman over Violations

Today (April 28), the Chau Duc District People's Committee, Ba Ria-Vung Tau province, requested the establishment of an Inspectorate to investigate the responsibility of the Chairman of the People's Committee of Ngai Giao Town in land management and illegal construction planning in the area.

Previously, the Department of Natural Resources and Environment of Chau Duc district collaborated with the People’s Committee of Ngai Giao town to inspect the construction of works and houses along Highway 30/4, Ngai Giao town (from the intersection of Tran Phu to Thanh Phat bus station).

The inspection team detected 10 constructions along this route violating the regulations on land, planning, and constructions without permits…

Specifically, 6/10 cases constructed houses exceeding the land area, 2 cases used land improperly (there were 8 cases without construction permits; 2 cases built houses on agricultural land). Most of the above constructions violated from 40 to 240m2.

As for planning, 3 constructions were built on land planned for greenery, public works with a total construction area of about 128.5m2.

According to the People’s Committee of Chau Duc district, all of the above constructions existed between 2014 and 2022, and the authority of Ngai Giao town did not initiate the establishment of files for handling administrative violations. By April 2024, the statute of limitations for administrative violations in the field of land and construction had expired…

The People’s Committee of Chau Duc district also said that for cases where the violated land location is consistent with the land use plan, master plan, and general plan, the district requires households to follow the procedures to change the land use purpose according to regulations and ensure that the land area is larger than or equal to the area of the constructed house.

If people do not make a file and follow the procedures to change the land use purpose, they will have to demolish the construction and restore the original state of the land.

The violations that do not comply with the planning and land use plan and the general plan of Ngai Giao town will have to demolish the construction, and the construction part in violation shall restore the original state of the land.

At the same time, the People’s Committee of Chau Duc district requested the district’s Inspectorate to establish an Inspection Team responsible for Mr. Nguyen Xuan Quang, Chairman of the People’s Committee of Ngai Giao town, in managing land and construction, and reporting the inspection results to the district People’s Committee before June 10, 2024.
