Deputy PM requests Ministry of Transport to comprehensively review and assess BOT traffic projects

The Ministry of Transport reviewed and comprehensively assessed the BOT transport projects.

On May 3, 2024, the Government Office issued Notice No. 190/TB-VPCP, summarizing Deputy Prime Minister Tran Hong Ha’s conclusions on solutions to address difficulties and obstacles in some infrastructure investment projects following the BOT contract model.

The Notice states: The Government has submitted a report to the National Assembly on solutions to address difficulties and obstacles in some infrastructure investment projects under the BOT model in Official Dispatch No. 402/TTr-CP dated October 11, 2022, and has received comments and instructions from the National Assembly Standing Committee in Notice No. 1843/TB-TTKQH dated November 28, 2022, issued by the Secretary-General of the National Assembly. The Government leaders have provided detailed and specific instructions on the content and progress in Official Dispatch No. 8352/VPCP-CN dated December 13, 2022, and Notice No. 428/TB-VPCP dated October 20, 2023. Despite the efforts of the Ministry of Transport to implement these instructions, the quality and progress of the Ministry of Transport’s preparation of the dossiers have not met the requirements of the Government leaders.

Deputy Prime Minister Tran Hong Ha requested that the Ministry of Transport take responsibility for reviewing and implementing the instructions of the National Assembly Standing Committee and the Government leaders in the above-mentioned documents accurately and completely; studying and incorporating comments from relevant agencies (via official documents and meeting discussions) to finalize the dossiers (Project Proposal) for reporting to the Politburo for comments.

The Deputy Prime Minister emphasized that the Ministry of Transport should continue to review and comprehensively assess all BOT transportation projects, including those managed by the Ministry of Transport and those managed by local authorities; thoroughly review subjective and objective causes, policy changes, and the responsibilities of relevant agencies; resolutely not propose handling projects caused by subjective factors of enterprises and investors (enterprises and investors must bear full responsibility according to the signed contracts); fully and carefully assess the negative impacts when implementing proposed mechanisms and policies for reporting to competent authorities for consideration and decision.

At the same time, report specific tasks that the Ministry of Transport, ministries, the Prime Minister, and the Government have carried out within their authority but have not yet resolved difficulties and obstacles of BOT transportation projects; clearly identify issues beyond the authority of the Government that need to be reported to competent authorities for consideration and decision (specifying the content for requesting comments from the Politburo).

The Deputy Prime Minister requested that the ministries and agencies: Finance, Planning and Investment, Justice, Government Inspectorate, and the State Bank of Vietnam, coordinate closely with the Ministry of Transport in the process of finalizing the dossiers; provide comments within the specified time when the Ministry of Transport seeks opinions.

Regarding the progress and submission of dossiers, the Deputy Prime Minister requested that the Ministry of Transport urgently implement the above contents, finalize the dossiers (in accordance with the regulations of the Working Regulations of the 13th Central Committee of the Party and the Working Regulations of the Government); proactively seek comments from relevant ministries and agencies (Ministry of Justice, Ministry of Planning and Investment, Ministry of Finance, Ministry of Public Security, Government Inspectorate, State Bank of Vietnam) and the agencies of the Party, the National Assembly, and fully incorporate and clarify responses before submitting to the Government Standing Committee in accordance with the Working Regulations of the Government.

The Ministry of Transport reported to the Party Executive Committee of the Ministry of Transport that it had sent a document to the Party Central Committee’s Office to report and request the Politburo’s comments on allowing a report in early May 2024; to finalize the dossier for reporting to the National Assembly at the 7th session (send a document to the National Assembly Office to report to the National Assembly Standing Committee for permission to submit the dossier before May 20, 2024).
