Land Law Taking Effect Soon to Untie Difficulties, Boost Economic Development

Deputy Minister of Natural Resources and Environment Le Minh Ngan believes that if the Land Law takes effect soon, it will help remove difficulties and obstacles, and shorten the time and costs of complying with procedures, contributing to promoting socio-economic development.

Prime Minister regular press conference on May 4 in the afternoon, reporter of Tien Phong newspaper asked about the progress of preparation for Land Law to take effect from July 1 till now? What does the Government expect about removing difficulties for the real estate market, boosting the socio-economy, and other issues after the Land Law takes effect?

In response, Deputy Minister of the Ministry of Natural Resources and Environment (MONRE) Le Minh Ngan said: After the Land Law was passed by the National Assembly, in order to boost land resources soon to serve socio-economic development, national defence, environmental protection, and sustainable development, putting land policies into practice soon, the Prime Minister has directed the MONRE, and relevant ministries, agencies to urgently prepare necessary conditions to submit to the National Assembly for permission to Land Law to take effect early on July 1, 2024.

Implementing the Prime Minister’s instructions, ministries and agencies such as MONRE, Ministry of Finance, Ministry of Agriculture and Rural Development, Ministry of Labour, Invalids and Social Affairs, Ministry of Home Affairs, local authorities at all levels, and the Ministry of Justice have urgently mobilized resources, with a very urgent progress and demanding very high quality, to develop legal documents guiding the implementation of the Land Law. These documents include Decrees, Circulars, then Decisions, legal documents under the competence of local authorities.

For MONRE alone, Mr. Ngan said, up to now, 6 draft decrees and 4 circulars have been assigned, and the drafts have been completed. The Ministry of Justice has conducted assessments. It is expected that before May 10, MONRE will submit to the Government implementing decrees in accordance with the instructions of the Prime Minister and Deputy Prime Minister Tran Hong Ha.

Other ministries and localities are also urgently completing the contents of their responsibilities, authority, to submit to the Government or issue according to their authority, ensuring that there are enough conditions to report to the Government for the Government to submit to the National Assembly, proposing that the National Assembly allow the Land Law to take effect on July 1, 2024.

In addition, MONRE is also assigned to consult with the Government on the draft Resolution of the National Assembly on the Land Law taking effect from July 1, 2024. The Ministry has completed the procedures, reported to the Government and sent to the Ministry of Justice for assessment.

“We expect to submit to the Government as soon as possible to ensure synchronization of both the Resolution, the draft Resolution of the National Assembly and guiding documents, ensuring the conditions for drafting documents”, said Mr. Ngan.

In terms of expectations, Mr. Ngan said, the Land Law in 2024 is to institutionalize the Party’s policies, focusing on Resolution 18 on land policies.

In addition to specialized contents such as land use planning, land use plans, land recovery, compensation, support, resettlement, land allocation, land lease, land use purpose conversion, land price , land finance… The 2024 Land Law was built on the principle of promoting decentralization, administrative procedure reform; reduce intermediate stages, reduce compliance costs and enhance responsibility and proactiveness for local authorities.

“This will remove some of the difficulties and obstacles identified in the summary of the 2013 Land Law. At the same time, it will shorten the time and cost of releasing land resources for socio-economic development, ensuring national defense, security, environmental protection, and sustainable development of the country, including land use rights and the real estate market”, said Mr. Ngan.

According to Mr. Ngan, to make the law effective soon, the propaganda and dissemination of the Land Law are also very important. Recently, the Prime Minister has directed and assigned the MONRE to organize a National Conference on the implementation of the Land Law nationwide, from Standing Committee of Provincial Party Committee, People’s Council, People’s Committee to specialized officials. The Ministry of Justice has coordinated with MONRE to deploy a National Conference in the justice sector… In the coming time, MONRE will actively coordinate with localities to continue disseminating.
