Unveiling the Truth: Exposing Malpractices in Binh Duong’s Two Industrial Parks

The Binh Duong provincial inspectorate has concluded its investigation, revealing a series of irregularities pertaining to Tan Binh Industrial Park and Rach Bap Industrial Park.

On May 9th, the Inspectorate of the Department of Construction of Binh Duong province announced the inspection conclusions on the investment procedures of technical infrastructure works of Tan Binh Industrial Park, with Tan Binh Joint Stock Company as the investor.

Tan Binh Industrial Park is located in Tan Binh town, Bac Tan Uyen district, and Hung Hoa commune, Bau Bang district, Binh Duong province.

According to the inspection conclusions, Tan Binh Company has not completed the procedure to adjust the area of the industrial park in accordance with Government Decree 29. After the People’s Committee of Binh Duong province approved the adjustment of the administrative address of Tan Binh Industrial Park (due to the separation of Tan Uyen district), the investor has not updated the location of the industrial park in the documents, specifically needing to state clearly: Tan Binh Industrial Park, in Tan Binh town, Bac Tan Uyen district, and Hung Hoa commune, Bau Bang district.

In terms of implementing the procedures for project establishment, appraisal, and approval, as well as construction permit issuance, since August 2014, Tan Binh Company has started the construction of the project’s infrastructure. However, at that time, the project had not been granted a construction permit by the competent authority.

Regarding investment in construction, the infrastructure works of Tan Binh Industrial Park have not been fully invested, and the project lacks a complete set of documents on quality management during the construction process. It has not been audited for traffic safety as prescribed, and the acceptance has not been carried out in the proper order and procedures for technical infrastructure works that have not been granted a construction permit by the competent authority, nor has it been inspected for fire prevention and control…

In terms of land procedures, the Tan Binh Industrial Park project has received the transfer of land use rights with a total area of nearly 330 hectares out of more than 350 hectares from households (nearly 23 hectares of 30 households have not yet agreed on compensation and site clearance).

The project has been granted a Certificate of Design Appraisal Approval for fire prevention and control for the infrastructure construction investment project. However, it has not been inspected and accepted by the competent authority as prescribed.

Based on the above shortcomings, violations, and limitations, the Inspectorate of the Department of Construction of Binh Duong province recommends that the People’s Committee of the province inspect the investment and construction situation in Tan Binh Industrial Park, and transfer the case to the competent authority for handling administrative violations by Tan Binh Company for its act of organizing the construction of works without a construction permit while a permit is required according to regulations.

Regarding Rach Bap Industrial Park (in Ben Cat town), the Inspectorate of the Department of Construction of Binh Duong province pointed out that the investor has committed many violations in the procedures for project establishment and approval, as well as investment and construction in this industrial park. Specifically, in the process of organizing the establishment, appraisal, and approval of the planning, and publicizing the planning scheme, the Rach Bap Industrial Park project has not obtained the opinions of related organizations and individuals during the planning process.

In terms of investment procedures, based on the decisions on approving adjustments to the detailed construction planning at a scale of 1/2000 and the planning adjustment schemes, the investor has organized the construction of several traffic routes: Route D1 (section within the project boundary), D2 (section within the project boundary), D3, D4, D5, D6, D7, D9, D10, and D11, which have been basically asphalted according to the approved planning.

Up to now, the investor has not established, appraised, and approved the project adjustment, and has not been granted a construction permit by the competent authority for the contents according to the adjusted construction planning details, which is not in accordance with the regulations.

The conclusion of the Binh Duong Provincial Inspectorate also pointed out that the project of investing in the construction of technical infrastructure of Rach Bap Industrial Park is not subject to a construction permit. However, the investor constructed technical infrastructure items that did not conform to the approved decision. Therefore, the investor constructed the works with content that deviated from the construction permit.

The project has been granted a certificate of appraisal approval for fire prevention and control for Rach Bap Industrial Park and residential area. However, this item has not been inspected and accepted by the competent authority.

Rach Bap Industrial Park has a total area of nearly 640 hectares, divided into two phases: Phase 1 has a scale of nearly 280 hectares, with a lease term until December 2055, and Phase 2 has a scale of nearly 360 hectares.
