“Addressing Inefficiencies: The Vice Premier Calls for Comprehensive Reforms in Housing Management and Development”

According to the report by the Ministry of Construction, the formulation and issuance of the Decree aim to concretize the contents stipulated in the Housing Law, which the National Assembly has assigned the Government to detail. It will serve as a legal basis for implementation, address limitations and problems in practice, further improve the investment and business environment, simplify administrative procedures, and ensure consistency and uniformity in the legal system.

The formulation of the draft Decree ensures consistency and harmony with relevant legal regulations, including laws on land, investment, management and use of public assets, real estate business, and construction. It also promotes decentralization, empowers local authorities, and enhances their responsibility in the field of housing development and management.

Deputy Prime Minister Tran Hong Ha requested that the drafting agency focus on clarifying the contents and new policies, and provide a comprehensive report on how they have addressed and explained the issues with differing opinions.

The draft Decree has institutionalized many current and new contents and policies on housing in a more concrete, detailed, and comprehensive manner. Specifically, it covers the group of procedures related to homeownership by foreigners; the order and procedures for formulating and adjusting provincial housing development programs and plans; the stages of investment projects for housing construction; procedures for developing and managing official residence housing, resettlement housing, and multi-story and multi-apartment housing. In addition, it includes methods of capital mobilization for housing development; regulations on conversion of housing functions; activities of management and use of housing belonging to public assets; and classification and management of apartment buildings.

At the meeting, some opinions discussed and clarified the regulations on homeownership by foreign organizations and individuals and the requirements for ensuring national defense and security. They also talked about the basis for building provincial housing programs and plans, the consistency and compatibility of regulations on preparing investment projects for housing construction with land, investment, and other relevant laws; and the simplification of procedures for investing in the construction of official residence housing.

They also discussed the modalities of renting, rent-to-own, and purchasing commercial housing, as well as arranging social housing for resettlement; the order and procedures for constructing multi-story and multi-apartment buildings, which should be similar to those for commercial housing projects; the necessity of regulations on apartment building classification, and the need to supplement criteria for environmentally friendly and green buildings; and the relationship between investors and residents in sharing responsibilities and conditions for ensuring the operation and management of apartment buildings.

Deputy Prime Minister Tran Hong Ha assigned the Ministry of Construction to continue studying and fully absorbing the opinions of localities, associations, and enterprises to thoroughly address the difficulties and obstacles in housing management and development. This will ensure that when the Decree is issued, it will be smoothly and effectively implemented.

The Ministry of Construction is requested to work with the Ministries of Finance, Natural Resources and Environment, Planning and Investment, National Defense, Public Security, and the State Bank to unify the handling of issues with differing opinions, ensuring connectivity and consistency with related laws.
