According to the report by the Ministry of Construction, the formulation and issuance of the Decree are to concretize the contents stipulated in the Housing Law that the National Assembly assigned the Government to detail and elaborate, creating a legal basis for implementation. It also aims to overcome limitations and shortcomings in reality, further improve the investment and business environment, simplify administrative procedures, and ensure consistency and uniformity in the legal system.

The formulation of the draft Decree ensures consistency and harmony with relevant legal regulations (such as laws on land, investment, management and use of public assets, real estate business, and construction); decentralization and devention of power, and enhancement of the responsibility of local authorities in the field of housing development and management.

Deputy Prime Minister Tran Hong Ha requested that the drafting agency focus on clarifying the contents and new policies, and report comprehensively on the way of reception and explanation of each issue with differing opinions.

Many current and new contents and policies on housing have been institutionalized in a more concrete, detailed, and comprehensive manner in the draft Decree. Specifically: The group of procedures related to homeownership by foreigners; the order and procedures for building, adjusting, and developing the housing program and plan at the provincial level; the stages of investment projects in housing construction; procedures for developing and managing official housing, resettlement housing, and multi-story and multi-apartment housing. In addition, there are methods of capital mobilization for housing development; regulations on conversion of housing function; activities of management and use of housing belonging to public assets; and classification and management of apartment buildings.

At the meeting, some opinions discussed and clarified the regulations on homeownership by foreign organizations and individuals and the requirements to ensure national defense and security; the basis for building provincial-level housing programs and plans; the consistency and compatibility of the regulations on preparing investment projects in housing construction with land, investment, and finance laws; and the simplification of procedures for investing in the construction of official housing.

At the same time, they discussed the ways of renting, rent-to-own, and buying commercial housing, arranging social housing for resettlement; the order and procedures for constructing multi-story and multi-apartment buildings in the same way as commercial housing projects; the necessity of regulations on apartment building classification, as well as the requirement to supplement green and environmentally friendly criteria; the relationship between investors and residents in sharing responsibilities and conditions for ensuring the operation and management of apartment buildings, etc.

Deputy Prime Minister Tran Hong Ha assigned the Ministry of Construction to continue studying and fully absorbing the opinions of localities, associations, and enterprises to thoroughly resolve difficulties and obstacles in reality related to housing management and development, ensuring that when the Decree is issued, it will be implemented smoothly and consistently.

The Ministry of Construction is requested to work with the Ministries of Finance, Natural Resources and Environment, Planning and Investment, National Defense, Public Security, and the State Bank to unify the handling of issues with differing opinions, ensuring connection and consistency with related laws.
