The new government decree, 101/2024/ND-CP, issued on July 29, 2024, introduces a streamlined process for the issuance and exchange of land-use rights certificates. This includes certificates for residential housing and other assets attached to the land.

Cases for re-issuance of previously issued Land Use Right Certificates:

1. Land users who wish to change their Land Use Right Certificates issued before August 1st, 2024, to Land Use Right and Asset Ownership Certificates.

2. Previously issued certificates are stained, blurred, torn, or damaged.

3. Previously issued certificates were issued for multiple land plots, but there is now a request to issue separate certificates for each plot according to the land user’s needs and the regulations for issuing Land Use Right and Asset Ownership Certificates.

4. The purpose of land use stated on the previously issued certificate differs from the land use classification defined in Article 9 of the Land Law and its implementing Decree-Law issued by the Government.

5. The location of the land plot on the previously issued certificate is inaccurate compared to its actual location at the time of certificate issuance.

6. The Land Use Right and Asset Ownership are jointly owned by a husband and wife, but the previously issued certificate only bears the name of either the husband or the wife. A request has been made to reissue the certificate with both spouses’ names.

7. The previously issued certificate bears the name of a household. Now, the household members with shared land use rights request a reissue to include the names of all members with these rights.

8. There has been a change in the address of the land plot for which the certificate was issued.

9. There are changes in the dimensions, area, or plot number of the land due to cadastral surveying or land parcel measurement, but the plot boundaries remain unchanged.

Documents required for the re-issuance procedure:

+ A completed Land and Asset-Attached Form No. 11/ĐK, as per the attached model, and the previously issued certificate.

In case (7) mentioned above, the Form No. 11/ĐK must include the information of all household members with shared land use rights.

+ For case (9), provide a cadastral map extract of the land plot.

Procedure and steps for re-issuance of previously issued certificates:

+ Land users or asset owners shall submit the required documents to the receiving agency: One-Stop Service Unit as per the regulations of the People’s Committee at the provincial, district, or communal level; Land Registration Office; or Branch of the Land Registration Office.

+ The receiving agency shall accept the application and schedule an appointment to return the results to the land user or asset owner.

If the receiving agency is the One-Stop Service Unit, it shall forward the application to the Land Registration Office as per the regulations of the People’s Committee.
