The draft circular guides the organization of legal knowledge tests on road traffic order and safety for drivers whose driving licenses have been fully deducted.
According to the draft, the agency in charge of conducting these tests is the Department of Road Traffic Police (under the Ministry of Public Security) or the Road Traffic Police Division of provincial/municipal police departments.
Drivers whose licenses have been fully deducted must undergo two types of tests: a theoretical test on a computer, and a practical test simulating traffic situations on a computer (for car drivers only). The theoretical test will be based on the set of questions used for the theoretical examination for the issuance of road vehicle driving licenses, as issued by the Ministry of Transport.
For motorcycle license holders, the test will consist of 25 multiple-choice questions, with each question worth one point. Choosing an incorrect answer for one particular question will result in a failing grade. A score of 21/25 or higher is required to pass.
Car and small truck license holders will take a similar test, also consisting of 25 multiple-choice questions, with one point awarded for each correct answer. Again, an incorrect answer to a specific question will result in a failing grade. A score of 23/25 or higher is needed to pass.
For medium truck and small bus license holders, the test will be longer, with 35 multiple-choice questions, each worth one point. An incorrect answer to a specific question will result in a failing grade. Passing requires a score of 32/35 or higher.
Large bus and truck license holders will face an even longer test, with 40 multiple-choice questions, each worth one point. As with the other tests, an incorrect answer to a specific question will result in a failing grade. A score of 36/40 or higher is necessary to pass.
Finally, for those with licenses for large buses and trucks with trailers, the test will also consist of 40 multiple-choice questions, each worth one point, with one question having a possible failing grade. Here, a score of 41/45 or higher is required to pass.
The time limit for the test is 10 minutes. The exam is designed with 10 questions simulating traffic situations, each worth a maximum of five points and a minimum of zero points. Each question presents a potential traffic hazard, and the test-taker’s responses will be recorded through their interactions with the computer, which has simulation software installed.
Test-takers must achieve a score of 35/50 or higher to pass. Those with motorcycle licenses who pass the theoretical test will have their driving licenses restored. Car license holders, however, must pass both the theoretical and practical tests to have their licenses reinstated.
If a test-taker fails the theoretical test, they will not be allowed to proceed to the practical test. However, if they pass the theoretical test but fail the practical test, their theoretical test results will be valid for one year from the date of passing.
Should a test-taker fail, they can re-register for the test after three working days from the date of completion of the previous test.
Article 58 of the Law on Road Traffic Order and Safety stipulates that the number of points deducted for each violation depends on the nature and severity of the violation.
If a driving license has not been fully deducted of points and no points have been deducted within 12 months from the date of the last point deduction, the license will be restored to its full 12 points.
After a waiting period of at least six months from the date of full point deduction, license holders can take the test on legal knowledge of road traffic order and safety. If they achieve a passing score, their license will be restored to 12 points.
