According to the decision, an adjustment was made to convert 2,984.0 sq. m of commercial service land in Thanh Phong commune, previously allocated to Hung Hoa Joint Stock Company, for residential purposes in rural areas. The land use term extends until March 25, 2069, and the recipient of the land use right transfer or the purchaser of the house attached to the land use right (if any) is entitled to permanent use. The land transfer is subject to a fee.
As per the People’s Committee of Ha Nam province, this adjustment was necessary due to a detailed construction planning adjustment at a 1/500 scale, as per Decision 491/QD-UBND dated March 23, 2021, issued by the People’s Committee of Ha Nam province.
The People’s Committee of Ha Nam province assigns the Department of Natural Resources and Environment to select and hire a consulting organization specialized in land price appraisal to determine the specific land price. This appraisal will then be submitted to the provincial land price appraisal council for evaluation before being presented to the People’s Committee of Ha Nam province for final approval. Consequently, the Hung Hoa Joint Stock Company will be required to pay land use fees in accordance with current regulations.
Simultaneously, the land use right certificates, along with ownership of houses and other assets attached to the land, will be granted to the land users upon complete settlement of their financial obligations. The People’s Committee of Ha Nam province is fully responsible for the completeness, legality, and compliance with regulations regarding the dossier, related documents, and the content advised by the Department concerning the adjustment of the residential land area allocated to Hung Hoa Joint Stock Company in the infrastructure construction project in Hung Hoa urban area, resulting from the detailed construction planning adjustment.
Once the specific land price for calculating land use fees is approved, the Ha Nam Provincial Tax Department will send a notification to Hung Hoa Joint Stock Company, requesting the payment of land use fees as stipulated. Guidance will be provided to facilitate the settlement of amounts that the company has advanced for compensation, support, and resettlement as per the approved plan.
The People’s Committee of Thanh Lien district will collaborate with the tax agency to guide the company in procedures for offsetting the amounts previously advanced for compensation, support, and resettlement in accordance with the approved plan against the land use fees to be paid, as per regulations.
Hung Hoa Joint Stock Company is responsible for using the land for its intended purpose, within the specified boundaries and area, and for fulfilling its financial obligations in a timely manner, as per the notification from the tax authority.
Previously, the Ha Nam Provincial Construction Inspectorate issued an administrative sanction decision against Hung Hoa Joint Stock Company for constructing a project in the Hung Hoa urban area without a valid construction permit.
