Who Can Retire at a Higher Age?

The 2019 Labor Code stipulates a gradual increase in the retirement age for employees under normal working conditions.

From 2021 onwards, the retirement age is 60 years and 3 months for male employees and 55 years and 4 months for female employees. Subsequently, the retirement age will increase by 3 months annually for males and 4 months for females until it reaches 62 years for males in 2028 and 60 years for females in 2035.

According to this timeline, in 2024, the retirement age for male employees under normal working conditions will be 61 years, and for female employees, it will be 56 years and 4 months.

According to the consolidated Decree No. 7/VBHN-BNV issued by the Ministry of Home Affairs, female officials and civil servants holding leadership and management positions may retire at an older age (but not exceeding 60 years old). These positions include:

  • Deputy Head of Party Committees at the central level; Deputy Director of the Ho Chi Minh National Academy of Politics, Deputy Editor-in-Chief of Nhan Dan Newspaper, Deputy Editor-in-Chief of Communist Magazine;
  • Vice Chairman of the Central Committee of the Vietnam Fatherland Front;
  • Vice Chairman of the Council for Ethnic Affairs, Vice Chairman of the Committees of the National Assembly, Vice Chairman of the National Assembly Office;
  • Deputy Chief Justice of the Supreme People’s Court, Deputy Prosecutor General of the Supreme People’s Procuracy;
  • Deputy Minister, Deputy Head of agency-level organizations;
  • Deputy Head of the Presidential Office, Deputy Auditor General of the State Audit Office;
  • Deputy Head of socio-political organizations at the central level;
  • Deputy Secretary of Provincial/Municipal Party Committees, Chairman of the Provincial/Municipal People’s Council, Chairman of the Provincial/Municipal People’s Committee;
  • Member of the Central Inspection Committee;
  • Director of the National Political Publishing House of Truth;
  • Director of the Institute for Legislative Studies under the Standing Committee of the National Assembly;
  • Director of Hanoi National University, Director of Ho Chi Minh City National University, General Director of Vietnam Social Security, Head of the Ho Chi Minh Mausoleum Management Board, Chairman of the National Financial Supervision Committee, Vice Chairman of the State Capital Management Committee at enterprises;
  • Vice Chairman of the People’s Council, Vice Chairman of the People’s Committee of Hanoi and Ho Chi Minh City
  • Permanent Member of the Council for Ethnic Affairs and the Committees of the National Assembly;
  • Permanent Member of the Hanoi and Ho Chi Minh City Party Committee;
  • Permanent Member of the Provincial/Municipal Party Committee who is an ethnic minority.

For civil servants appointed to the positions of Judge of the Supreme People’s Court and Prosecutor of the Supreme People’s Procuracy, the retirement age may also be extended, but not exceeding 65 years for males and 60 years for females.

These officials and civil servants, when decided by competent authorities to retire at an older age, shall continue to hold their leadership and management positions. During the implementation of this policy, if an official or civil servant wishes to retire early, they shall be entitled to retirement benefits as prescribed by law.

This Decree does not apply to: Officials holding the position of Minister or equivalent or higher; Female officials and civil servants holding the above positions who are members of the Central Party Committee; Assistants and secretaries of the General Secretary, President, Prime Minister, Chairman of the National Assembly, Permanent Member of the Secretariat, Politburo Member, Secretariat Member, Vice President, Deputy Prime Minister, Vice Chairman of the National Assembly. The retirement age for these cases shall be decided by the competent authorities of the Party.
