The Newest Victims: Four Major Nha Trang Projects Cancelled Post-Approval

The four major projects in Nha Trang City have had their land price approval decisions revoked by the People's Committee of Khanh Hoa Province, just over ten days after they were initially approved.

On August 31, the People’s Committee of Khanh Hoa province announced its decision to revoke four previous decisions (specifically, Decisions No. 2116, 2133, 2151, and 2161) regarding land price approval for four major projects in Nha Trang city.

These decisions pertained to the approval of land prices for the Napoleon Castle I Apartment project (located at 25-26 Nguyen Dinh Chieu), the Le Hong Phong II New Urban Area project, the Phuoc Long New Urban Area project, and the determination of land rent prices for a plot of land on Yersin Street in Nha Trang. The reason for revoking these decisions was due to their reliance on legal documents that are no longer in effect.

The Napoleon Castle I Apartment project is undergoing a land price reassessment due to planning adjustments.

Prior to this, on August 28, the Khanh Hoa Department of Natural Resources and Environment submitted a document to the provincial People’s Committee regarding the issuance of decisions on specific land prices for dossiers submitted before August 1, 2024. The approval of land prices for these projects forms the basis for determining financial obligations and issuing land use certificates for residents of certain real estate projects in the area. This, in turn, provides a foundation for applying land price calculation methods for real estate projects that have undergone legal changes but lack updated land prices.

According to the Khanh Hoa Department of Natural Resources and Environment, the four land price schemes submitted to the provincial People’s Committee before August 1, 2024, will have their land prices determined based on the submitted schemes without applying the provisions of the 2024 Land Law. The People’s Committee’s decision to approve these land prices is in line with Article 257, Clause 3 of the 2024 Land Law.

However, while the four decisions on specific land price approvals were issued after August 1, 2024, the legal basis for these decisions referenced the 2013 Land Law and its implementing decrees and circulars, which have been invalid since August 1, 2024. As a result, these decisions needed to be revoked. Thus, just over ten days after the initial approval decisions, the People’s Committee of Khanh Hoa province has now revoked them.
