The People's Council of Ha Nam Province has recently passed a resolution outlining the criteria for selecting investors through bidding for projects involving land use for urban and rural residential area development within the province.

This Resolution prescribes the criteria for deciding to conduct bidding to choose investors for projects involving land use (i.e., construction of urban areas with mixed-use functions, synchronous technical and social infrastructure with residential areas as prescribed by the Law on Construction to build or renovate urban areas, and construction of rural residential areas) in Ha Nam province, as stipulated in Point a, Clause 1, Article 126 of the Land Law.

Ha Nam province has a Resolution that sets out the criteria for deciding to conduct bidding to choose investors for projects involving land use for the construction of urban and rural residential areas. Illustrative image.

According to the Resolution, the construction projects of urban and rural residential areas will undergo bidding to select investors when they fully meet the following criteria:

First, they fall under the case of land recovery by the State as prescribed in Clause 27, Article 79 of the Land Law.

Second, in terms of scale and area: The urban area construction must comply with the regulations prescribed by the Law on Construction; The rural residential area construction must have a land use scale of 03 hectares or more.

Third, for land that has not completed compensation, support, and resettlement. In cases where the land area for project implementation has land as prescribed in Clause 1, Article 217 of the Land Law and does not meet the conditions for separation into an independent project in accordance with the law on land, the bidding for the selection of investors for the project shall be carried out for the entire land area.

The Provincial People’s Council assigns the Provincial People’s Committee to organize the implementation of this Resolution. During the implementation process, if the contents of this Resolution are inconsistent with the contents of documents issued by central agencies after this Resolution takes effect, the implementation shall be in accordance with the documents of the central agencies; at the same time, report and propose to the Standing Committee of the Provincial People’s Council for consideration and approval to present to the Provincial People’s Council for adjustment, amendment, and supplement of the Resolution at the nearest session to ensure compliance with the law.

Point a, Clause 1, Article 126 of the Land Law stipulates that for projects as prescribed in Clause 27, Article 79 of this Law, the Provincial People’s Council shall decide on land allocation or lease through bidding for the selection of investors for projects involving land use. The Provincial People’s Council shall prescribe the criteria for deciding to conduct bidding for the selection of investors for projects involving land use, suitable to the actual situation of the locality.
