The Magic City’s Solution: Unraveling the Mystery of 9,000 Land Files

The Ho Chi Minh City People's Committee has proposed a solution to resolve financial obligations and land-related tax issues, which have caused a backlog of nearly 9,000 land dossiers.

The Vice Chairman of Ho Chi Minh City People’s Committee, Bui Xuan Cuong, has recently issued an official dispatch regarding the settlement of financial and land-related tax obligations while the city awaits the issuance of a decision to amend and supplement Decision No. 02/2020 by the Ho Chi Minh City People’s Committee. This decision, as per Clause 1, Article 257 of the 2024 Land Law, stipulates land prices.

Ho Chi Minh City People’s Committee decides to apply the land price framework from Decision 02/2020 for settling financial obligations.

Consequently, the city has agreed to employ the land price schedule, promulgated in accordance with the 2013 Land Law, which was in effect before August 1st (the land prices as per Decision No. 02/2020 multiplied by the land price adjustment coefficient as per Decision No. 56/2023 issued by the HCMC People’s Committee). This will be used to settle financial and land-related tax obligations from August 1st onwards, until the amended Decision No. 02/2020 comes into effect.

The Ho Chi Minh City People’s Committee has entrusted the Department of Taxation to collaborate with the Department of Natural Resources and Environment, the Department of Finance, and other relevant units. They will work together to resolve the backlog of land-related dossiers that have arisen since August 1st, in accordance with legal regulations regarding financial obligations, taxes, and other pertinent laws (land use fees, land rent, personal income tax from real estate transfers, and other land-related revenues).

According to a recent report by the Ho Chi Minh City Department of Taxation, from August 1st to August 27th, there were over 8,800 pending land and housing dossiers awaiting processing, pertaining to financial obligations. These included 364 dossiers for land-use rights recognition, 277 for change of land-use purpose, 5,448 for real estate transfers, and 2,737 with no financial implications (such as personal income tax from real estate transfers and registration fees). These cases remained unresolved as the tax authority awaited new guidelines on calculation methods following the enforcement of the 2024 Land Law and Decree No. 103/2024/ND-CP on August 1st.
