Selling a Plot of Land to Multiple Buyers, Ex-officer Jailed for 12 Years

A clever scheme, but one that would unravel as soon as the new owners realized their purchase was not as exclusive as they thought.

The People’s Court of Hau Giang Province recently held the second first-instance trial to prosecute Nguyen Viet Trieu (born in 1979, residing in Binh Thuy district, Can Tho city) for “Fraudulent appropriation of property.”

According to the indictment, Trieu was allocated land by the state as a cadre of the police force who was assigned to work in Hau Giang province.

Upon receiving the land allocation decision, Trieu agreed to sell the decision to Mr. Pham Van Hoa (Vi Thanh city, Hau Giang province) for VND 40 million. In February 2015, Trieu obtained a land use right certificate ( red book ) and handed over the book to Mr. Hoa.

However, in October 2015, on the pretext of losing the red book (which had been given to Mr. Hoa earlier), Trieu applied for a re-issue and was granted a second book for the same land plot by the People’s Committee of Vi Thanh city.

With the new red book, in May 2019, Trieu transferred the land plot to Mr. Nguyen Hoang Khanh for VND 330 million.

In November 2019, Trieu again applied for a new book on the pretext of losing the aforementioned book. Due to a lack of verification, the Vi Thanh City Branch of the Land Registration Office advised the Hau Giang Department of Natural Resources and Environment to issue a third red book to Trieu.

In November 2021, Trieu continued to transfer the land to Mr. Phan Doan Huynh Bao (Soc Trang province) for VND 630 million.

The investigating agency determined that Nguyen Viet Trieu had used fraudulent schemes to appropriate a total of VND 960 million from the victims.

The court sentenced Nguyen Viet Trieu to 12 years in prison for “Fraudulent appropriation of property” according to Clause 4, Article 174 of the Criminal Code.
