Regarding the information on “Land encroachment in apartment buildings” published in the Nguoi Lao Dong newspaper, recently, the People’s Committee of Tang Nhon Phu A Ward, Thu Duc City, Ho Chi Minh City, has issued a document on inspecting and handling the encroachment and misuse of land at the C5, C6 apartment building’s park.

The document was signed by Mr. Ngo Van Hoang, Vice Chairman of the People’s Committee of Tang Nhon Phu A Ward.

Previously, the People’s Committee of Tang Nhon Phu A Ward coordinated with the local police and the Management Board of C5, C6 apartment buildings to inspect and verify the reflection of the encroachment and misuse of land in the park surrounding the C5 and C6 apartments.

The People’s Committee of Tang Nhon Phu A Ward requested individuals and organizations to voluntarily dismantle and cease the encroachment of public space for business and trading activities, as well as misuse of land in the park surrounding the C5 and C6 apartments. The deadline for self-dismantling and restoration of the site is before October 4, 2024.

From this date, the People’s Committee will conduct inspections and apply legal violation handling measures to recover and restore the original status of the land.

The People’s Committee also requested the Management Board of C5 and C6 apartments to make minutes of the meeting, requiring the owners of the apartments to stop the illegal connection and tapping of electricity from the households, which poses a threat to electrical safety and fire prevention and fighting. They were also instructed to report any such violations to the People’s Committee for timely handling.

Additionally, Mr. Nguyen Phu Sang, the official in charge of Land, Construction, and Environment, was assigned to closely monitor the situation and promptly advise and issue administrative violation records in accordance with the law if individuals or organizations fail to take corrective actions and dismantle the encroachments.

The People’s Committee also proposed that the Fatherland Front of the Ward and the Head of Zone 3 coordinate to inspect and supervise the handling of violations and encroachment of the land in the park surrounding the C5 and C6 apartments.

As reported by Nguoi Lao Dong newspaper, recently, residents of the C5 and C6 apartments expressed their dissatisfaction to the newspaper about the illegal occupation of the apartment’s land for business purposes.

According to observations, about seven establishments in the area have set up tables and chairs and erected umbrellas for selling beverages. These activities take place from morning to night.

In a conversation with the reporter, Ms. Luong Thi Thu Thao, Head of the Management Board of C5 and C6 apartments, shared that currently, there are about 1,000 residents living in the complex. According to the apartment’s construction design and land use planning, the residents are entitled to the shared use of over 7,500 square meters of land. This includes an area of more than 2,000 square meters adjacent to the Man Thien Road and D2 Road, which, as per regulations, must serve the common purposes of the residents.

However, for many years, some residents and outsiders have encroached upon this land for business activities, leaving adults without a place for morning exercises and children without a playground. Moreover, these commercial activities disrupt order and pose risks to fire prevention and fighting.

Up to now, the management board has sent multiple petitions to the competent authorities requesting a solution, but to no avail. “The encroachment of apartment land is a serious violation of the law, and it has been happening since 2016. The management board and residents eagerly await the timely and thorough resolution of this issue by the authorities, in accordance with the law, to restore fairness and protect the legitimate rights and interests of the residents,” said Ms. Thao.
