The Trade Remedies Authority (Ministry of Industry and Trade) announced that it has received information regarding South Africa’s official initiation of an anti-circumvention investigation on automotive, bus, and truck tires originating from or imported from Thailand, Cambodia, and Vietnam. The investigation alleges circumvention of anti-dumping duties imposed on China.
The products subject to investigation are automotive, bus, and truck tires classified under the South African import tariff codes 4011.10.01, 4011.10.03, 4011.10.05, 4011.10.07, 4011.10.09, 4011.20.16, 4011.20.18, and 4011.20.26.
The applicant for this investigation is the South African Tire Manufacturers Conference. The date of initiation is September 20, 2024, with the period of investigation for anti-dumping being November 1, 2023, to May 31, 2024. The period of investigation for circumvention is set as March 1, 2022, to September 30, 2022; October 1, 2022, to April 30, 2023; April 1, 2023, to October 31, 2023; and November 1, 2023, to May 31, 2024. The alleged dumping margin for Vietnam is 84%.
Previously, in May 2023, the International Trade Administration Commission of South Africa (ITAC) issued a decision to impose anti-dumping duties on automotive, bus, and truck tires originating from or imported from China, ranging from 7.18% to 43.60%.
Regarding the investigation procedure, the Trade Remedies Authority informed that related documents, including the public version of the application file, the initiation notice, and the questionnaire, will be sent to relevant Vietnamese manufacturing and exporting enterprises within seven days from the initiation date, i.e., by September 27, 2024.
The deadline for the enterprises to submit their questionnaire responses is 3:00 PM on October 28, 2024 (South African time), via postal mail to the following address: The Senior Manager, Trade Remedies II, Private Bag X753, PRETORIA, 0001, South Africa.
Enterprises may also send their arguments or comments related to the case to the same address via postal mail.
In the subsequent stages of the investigation, the International Trade Administration Commission of South Africa will issue preliminary and final conclusions, conduct on-site inspections, and hold hearings to verify information and make decisions regarding circumvention, injury to the domestic industry, and the causal link.
The Trade Remedies Authority recommends that the Association and relevant manufacturing and exporting enterprises carefully study the application file, initiation notice, guidelines, and regulations. They should also cooperate fully and comprehensively in answering the questionnaire and providing information as requested by the International Trade Administration Commission of South Africa. Additionally, they should diversify their export markets.
In the event of an anti-dumping duty imposition, it is highly likely that the member countries of the Southern African Customs Union (including Botswana, Lesotho, Namibia, South Africa, and Swaziland) will take similar actions. The Association and relevant enterprises should regularly provide information and updates to the Trade Remedies Authority to receive timely support.
