The New Face of Hanoi: Embracing Spaciousness with a 50 m2 Minimum Lot Size

Under new regulations set out by Hanoi authorities, the minimum land area for detached residential plots is now 50 sq. m, an increase of 20 sq. m from the previous regulations. This change will take effect from October 7th onwards.

The Hanoi People’s Committee has issued Decision No. 61, stipulating important contents related to land management and use in the city. The Decision, which takes effect on October 7, applies to state agencies, land users under the Land Law, and related parties in land management and use in the area.

According to the Decision, for residential land, the area outside of roads, traffic infrastructure, and public spaces must not be smaller than 50 sq. m, with a length of over 4 m and a width adjacent to the road of 4 m or more. For plain communes, the minimum area for subdivision is 80 sq. m, 100 sq. m for midland communes, and 150 sq. m for mountainous communes.

For commercial and service land in wards and townships, the minimum length and width must be 4 m and 10 m, respectively, with an area of at least 400 sq. m. In communes, the minimum area for commercial and service land is 800 sq. m.

Non-agricultural land that does not fall under the commercial or service group requires a minimum area of 1,000 sq. m in wards and townships and 2,000 sq. m in communes. For agricultural land, the minimum area for annual crop land in wards and townships is 300 sq. m, 500 sq. m for perennial crops, and 5,000 sq. m for production forests.

If land users wish to reserve a portion for a pathway, the lot must ensure that the pathway has a width of at least 3.5 m in wards and townships and 4 m in communes. After subdivision, the lot must still meet the conditions for the type of land specified in the Land Law.

Currently, land subdivision in Hanoi is carried out according to Decision No. 20/2017 of the Hanoi People’s Committee on issuing Regulations on land allocation limits, recognition of land use rights, dimensions, and minimum area of land allowed for subdivision for households and individuals in Hanoi. Accordingly, the post-subdivision lot must have a minimum area of 30 sq. m in wards and townships and not less than 50% of the new minimum land allocation limit in other areas.
