The Ho Chi Minh City People’s Committee has issued a decision to supplement the management of underground construction space planning for detailed planning schemes with a scale of 1/5,000 and 1/2,000, and detailed construction planning schemes with a scale of 1/2,000 that have been approved. This decision will come into effect on September 14, 2024.

The addition of underground construction space management to the approved planning schemes that are still valid by the Ho Chi Minh City People’s Committee aims to resolve issues in granting construction permits for structures with basements in the past.

According to the new underground space management regulations, for the group of low-rise and detached houses, a maximum of one basement is allowed to be constructed to accommodate technical floors and parking lots.

In the case of detached houses with combined functions, if there is a need to build two or more basements, a detailed plan or a master plan, i.e., a simplified detailed plan, must be established.

For the group of high-rise buildings such as apartments, service, public, and office buildings; structures in export processing zones and industrial parks, and other construction works… the construction of basements is permitted in accordance with construction standards and norms. The number and location of basements for these structures are specified in the detailed planning schemes, permit drawings, and basic designs.

The supplementary decision of the Ho Chi Minh City People’s Committee notes that the construction of urban underground structures must comply with the following: The construction boundary must not exceed the land use limit, and if it does, permission must be obtained from the competent authority; ensuring the safety of the community and not affecting neighboring structures.

In addition, the basement serving parking and technical system needs will not be counted in the land use coefficient. In case the basement is used for purposes other than these functions, the calculation of basement floor areas into the land use coefficient must ensure that it does not exceed the permitted coefficient according to the planning.

Along with the above decision, the Ho Chi Minh City People’s Committee announced a list of 375 detailed planning schemes that are currently in effect and will be supplemented with regulations on the management of underground urban construction space planning. These include schemes from districts such as Cu Chi (82 schemes), Binh Chanh (38), Nha Be (36), Hoc Mon (36), and District 12 (26), among others.
