The Ministry of Labour, Invalids, and Social Affairs has submitted a report to the Prime Minister, clarifying the proposed plan for a nine-day Tet holiday for the Lunar New Year in 2025. This proposal applies to officials, public employees, and workers in administrative, public service, political, and socio-political organizations.
According to the Ministry, the Government Office previously issued a document conveying the Prime Minister’s directive, requesting the Minister of Labour, Invalids, and Social Affairs to study and clarify the Tet holiday proposal.
On this matter, the Ministry of Labour, Invalids, and Social Affairs stated that Clause 1, Article 112 of the Labor Code stipulates that employees are entitled to paid time off during the Lunar New Year holiday, amounting to five days.
Additionally, Decision No. 188/1999/QD-TTg regulates the workweek for public employees and civil servants as 40 hours across five days, with Saturdays and Sundays as their weekly days off.
In line with these regulations, the Ministry proposed in Official Dispatch No. 5152/LDTBXH-CATLD that the Tet holiday for civil servants and public employees should span five consecutive days, from Monday, January 27, 2025 (the 28th day of the twelfth lunar month) to Friday, January 31, 2025 (the 3rd day of the first lunar month). This proposal adheres to the provisions of the Labor Code and the Government’s regulations.
Furthermore, the Ministry explained that due to the unique calendar configuration in 2025, where both the days before and after the Lunar New Year fall on weekends, civil servants and public employees will benefit from a nine-day break, combining the five-day Tet holiday with their regular four-day weekend.
