This resolution sets out the criteria for deciding to conduct bidding to select investors for construction projects of urban areas with mixed-use functions, synchronous technical and social infrastructure with residential development as prescribed by the Law on Construction. This is to renovate and embellish urban areas or construct rural residential areas in Tay Ninh Province.

The subjects of this resolution are the Provincial People’s Committee, the departments, branches, and agencies at the provincial level involved in managing and organizing the implementation of land allocation and lease through bidding to select investors for projects using land. Organizations and individuals involved in the bidding process for selecting investors for projects using land are also subject to this resolution.

Specifically, the criteria for deciding to conduct bidding to select investors for projects using land must conform to the planning of Tay Ninh Province, urban sub-planning, commune planning, detailed planning of rural residential areas, and district-level land use planning approved by competent authorities.

It should also align with the Housing Development Program and the Urban Development Program approved by the competent authorities.

In terms of scale, the land area should be 20 hectares or more for urban areas and 5 hectares or more for rural residential areas. It should not fall under the case of auctioning land use rights as prescribed in Article 125 of the 2024 Land Law.
