The electronic voting results showed that out of 423 National Assembly deputies, 421 agreed, accounting for 87.89% of the total number of deputies.

Accordingly, the National Assembly’s Resolution on “Continuing to improve the effectiveness of the implementation of policies and laws on real estate market management and social housing development” decided to assign the Government to immediately perform the following tasks and solutions.

National Assembly passes Resolution with high approval rate

For newly issued laws related to real estate market management and social housing development, such as the 2023 Law on Real Estate Trading, the 2023 Housing Law, the 2023 Bidding Law, and the 2024 Land Law, it is proposed to immediately deploy the following tasks and solutions: Focus on directing ministries, ministerial agencies, and localities to complete the issuance of documents providing details and guiding the implementation within their assigned authority. Continue reviewing and perfecting the documents providing details and guiding the implementation to ensure that the shortcomings and limitations of the 2015-2023 period and any problems arising in the process of deploying new regulations are addressed, creating a safe, sufficient, favorable, stable, and feasible legal corridor for investment, production, and business activities of enterprises and the lives of people, especially transitional provisions, ensuring fair, public, and effective access to land and other resources.

Focus on directing the work of guiding and organizing the implementation of financial and land-related laws, paying attention to land valuation, building and adjusting land price frames, and other related policies to maintain a reasonable level of land-related costs as input costs for the economy, ensuring a balance of interests between the State, land users, and investors in the spirit of Resolution No. 18-NQ/TW dated June 16, 2022, of the 5th Plenum of the 13th Party Central Committee on continuing to innovate, perfect the institution, policy, raise the effectiveness of land management and use, creating a driving force for our country to become a developed country with high income.

Promote the issuance of documents providing details and organize the effective implementation of laws and resolutions related to real estate market management and social housing development passed by the National Assembly at the 8th Session, such as the Law on Urban and Rural Planning, the Law on Geology and Minerals, the Law on Fire Prevention and Fighting and Rescue, the Law on Notarization (amended), the Law on Cultural Heritage (amended), the Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment in the form of Public-Private Partnership, and the Bidding Law, the Resolution on piloting the implementation of commercial housing projects through agreements on the transfer of land use rights or having land use rights, and the Resolution on mechanisms and policies to remove difficulties and obstacles for projects and land in the conclusions of inspection and audit and judgments in Ho Chi Minh City, Da Nang City, and Khanh Hoa Province.

For the draft laws submitted to the National Assembly for comments at the 8th session related to real estate market management and social housing development, such as the Law amending and supplementing a number of articles of the Law on Standards and Technical Regulations, and the Law on Urban Development Management, which will be submitted to the National Assembly at the 9th session: It is proposed to study and have a mechanism to resolve difficulties and obstacles in reality based on an objective assessment of the implementation of legal provisions through periods; clearly distinguishing whether the obstacles are due to the provisions of the Law, guiding documents, or the organization of implementation, in order to propose appropriate and feasible solutions.

Have appropriate solutions to handle decisively real estate projects that are having difficulties and legal entanglements, stagnation due to prolonged implementation, and changes in the law over the periods, based on a comprehensive consideration of objective practical factors, specific historical circumstances, and a full assessment of benefits and costs and the feasibility of the solution to ensure the legitimate rights and interests of the State, the people, and enterprises, for the common and general interests, releasing resources for the real estate market and creating a driving force for socio-economic development; not “criminalizing” economic and civil relations; clarifying the content of “not legitimizing violations.”

Have specific solutions and guide ministries, sectors, and localities to remove obstacles related to land management and use in the process of equitizing State-owned enterprises and divesting State capital from enterprises; have mechanisms and policies to handle cases where the land use plan after equitizing State-owned enterprises and divesting State capital from enterprises is no longer suitable for planning; have specific solutions to remove obstacles in the implementation of signed build-transfer (BT) contracts, completing them in 2025.
