The draft criteria for identifying small, narrow, and interspersed plots of land will be based on Clause 1, Article 47 of the Government’s Decree No. 102/2024/ND-CP detailing the implementation of a number of articles of the 2024 Land Law.

In the second quarter of each year, the People’s Committee of the communal level will inspect, and establish a list of interspersed public land plots. Within 10 days, this list must be publicly posted at the communal People’s Committee headquarters, residential areas, wards, or community houses where the land is located, etc. At the same time, the adjacent land users must be notified in writing to provide their opinions on the proposed use of the narrow land plot for public purposes, including leasing or renting the land to adjacent users; and to gather opinions on the area and status of the adjacent land plots.

After the 30-day posting period, the relevant units will continue to inspect and finalize the list for approval by the district-level People’s Committee.

The Department of Natural Resources and Environment is responsible for registering the annual land use plan and reporting it to the Department of Natural Resources and Environment for submission to the City People’s Committee for approval as prescribed by law.

Once the annual land use plan is approved, the communal-level People’s Committee (where the land is located) shall publicly announce the annual land use plan and disclose the management and use of interspersed public land in accordance with regulations.

Within 30 working days, the district-level People’s Committee shall direct the units and localities to manage and implement the regulations on the use of land for public purposes.

For land plots where the authority to lease or rent land to adjacent land users belongs to the district-level People’s Committee, the Department of Natural Resources and Environment shall advise the district-level People’s Committee to decide on leasing or renting the land in accordance with Clause 2, Article 47 of Decree No. 102/2024/ND-CP.

For land plots where the authority to lease or rent land to adjacent land users belongs to the City People’s Committee, the Department of Natural Resources and Environment shall notify the registered land users to contact the Department of Natural Resources and Environment for guidance in accordance with legal regulations.

This regulation is expected to facilitate the combination of small land plots into larger ones, improve the urban landscape, reduce land resource wastage, meet the needs of the people, and increase state budget revenues.

Interspersed public land has been one of the main reasons for the stagnation of commercial housing projects in Ho Chi Minh City. According to the Ho Chi Minh City Real Estate Association (HoREA), there are about 126 commercial housing projects in the city that are delayed or suspended due to interspersed public land plots, although these plots account for only about 10% of the total area of the projects.
