The Ho Chi Minh City People’s Committee has issued a document to the departments, the People’s Committees of the districts and Thu Duc City, and the Real Estate Registration Office, permitting mixed-use land to be converted for residential purposes, and granting construction permits and land division approvals.

According to the document, for blocks with mixed-use functions, including residential, commercial, public works, parks, and others, where specific land function allocations cannot be determined in the approved 1/2,000 scale subdivision plan, the People’s Committees of the districts, Thu Duc City, and relevant authorities are required to review and propose adjustments to the 1/2,000 scale subdivision plan.

Alternatively, they can initiate the formulation, appraisal, and approval of a 1/500 scale detailed plan for these blocks to identify the specific residential land areas within the block, providing a basis for land use conversion, construction permits, and land division.

Regarding the conversion of land use from other types to residential for households and individuals in Ho Chi Minh City in areas zoned for residential groups in subdivision plans as per the Urban Planning Law, the People’s Committee directs compliance with the 2024 Land Law and Decree 102/2024.

The location of the land proposed for conversion must conform to the approved planning, specifically designated as residential land, and adjacent to existing or newly formed roads under the management of the People’s Committees of the districts, Thu Duc City, and relevant authorities, as stipulated in approved planning documents.

Ho Chi Minh City allows mixed-use land to be converted for residential purposes, with construction permits and land division approvals.

The area of land to be converted from other types to residential will be based on the actual needs of each household and individual, and will be considered and resolved in accordance with regulations. During the implementation process, should any difficulties or obstacles arise, the People’s Committees of the districts, Thu Duc City, and relevant authorities are requested to promptly report to the Department of Natural Resources and Environment (for matters related to land), the Department of Planning and Architecture (for planning-related matters), and the Department of Construction (for matters related to construction and housing) for guidance and resolution.

To effectively handle the conversion of land use from other types to residential for households and individuals in Ho Chi Minh City in areas zoned for residential groups in subdivision plans, as per the Urban Planning Law, the People’s Committee instructs the heads of departments, the Chairpersons of the People’s Committees of the districts, and Thu Duc City to strengthen the control and state management of land, construction, and planning.

Additionally, they are tasked with promptly detecting and strictly handling any acts of taking advantage of policies and legal provisions to engage in illegal land use conversion, land division, and construction for personal gain, which disrupts the approved planning and impacts urban development.

The Ho Chi Minh City People’s Committee requests the Department of Natural Resources and Environment, the Department of Planning and Architecture, the Department of Construction, and the Department of Transport to provide guidance to the People’s Committees of the districts and Thu Duc City in executing the conversion of land use from other types to residential for households and individuals, in accordance with their respective functions and tasks. In cases where the authority exceeds their jurisdiction, they are to report and propose to the Ho Chi Minh City People’s Committee for consideration and decision.

The People’s Committees of the districts, Thu Duc City, and relevant authorities shall base their handling of the conversion of land use from other types to residential for construction of houses by households and individuals on the provisions of the Land Law, Housing Law, Planning Law, Construction Law, and other relevant legal documents.
