The Ho Chi Minh City People’s Committee has issued a procedure for land fund payment to build-transfer (BT) contract projects under the special mechanism and policies of Resolution 98.
Regarding the conditions for land fund payment, the procedure states that the land used for payment must be state-owned and fall under the category of arranging and handling public assets, as specified in the BT contract.
Additionally, the land used as payment to the investor must have a detailed planning approval at a 1/500 scale, serving as the basis for determining financial obligations.

The timing of land transfer and lease for BT contract payment is based on the completed volume of the BT project, which must be approved by authorized agencies and audited.
In the process of land transfer and lease, the Ho Chi Minh City People’s Committee requires the authorized agency to determine the financial obligations of the investor. Moreover, land and rental fees are calculated at the time of the decision on land allocation or lease.
The procedure for land fund payment to BT project investors consists of four steps.
Step 1: Develop, appraise, and approve a detailed plan at a 1/500 scale or a general layout of the land area. This step should take approximately 35 working days.
Step 2: Proceed with land allocation and lease. This step is carried out by the Department of Natural Resources and Environment within 30 working days.
Step 3: The Department of Natural Resources and Environment determines the land price. This step should be completed within 180 days from the date of the decision on land allocation or lease.
Step 4: The Department of Natural Resources and Environment issues the land use right certificate within three days from the date of the investor’s completion of financial obligations, as confirmed by the tax authority.
According to statistics from the Ho Chi Minh City People’s Committee, there are 13 BT projects in the city that have signed contracts. Not only are there projects that have been left unfinished, but there are also projects that have been completed and put into operation for many years, yet the payment and final settlement procedures remain unresolved.
