On December 20, the Office of the President held a press conference to announce the President’s order promulgating nine laws passed by the 8th session of the 15th National Assembly, including the Law on Fire Prevention, Fighting and Rescue and Salvage 2024.

At the press conference, Major General Nguyen Ngoc Lam, Deputy Minister of Public Security, said that recently, the fire and explosion situation has been complex, especially in big cities and urban areas with high population density and many new types of establishments.

According to Mr. Lam, this situation urgently requires strengthening solutions and measures to improve the effectiveness of state management in fire prevention and control. Amending and supplementing the legal provisions on fire prevention and control is necessary to promptly create a legal basis for the effective implementation of state management in this field in practice.

Mr. Lam also emphasized that the enactment of the law helps overcome some limitations and shortcomings identified by the National Assembly’s supreme oversight, such as the responsibilities of agencies, organizations, and individuals in fire prevention, fighting, and rescue and salvage; the application of technical standards and norms in this field; ensuring electrical safety; building specialized fire prevention and control forces, as well as establishment-based and people’s fire prevention and control forces; and organizing voluntary fire prevention and control activities.

At the press conference, the media raised the issue of the recent arson attack on a cafe in Hanoi that resulted in the deaths of 11 people, pointing out that the combination of residential and production/business spaces poses significant risks and dangers in terms of fire and explosion safety. How does the newly promulgated law address this issue?

In response, Major General Pham Cong Nguyen, Director of the Department of Legal Affairs and Administrative Reform (Ministry of Public Security), acknowledged that the combination of residential and production/business spaces carries a very high risk of fire and explosion incidents, as evidenced by the recent tragic events.

“The Law on Fire Prevention, Fighting and Rescue and Salvage has thoroughly reviewed and evaluated the conditions and regulations to ensure feasibility and address this situation,” said Mr. Nguyen.

According to Mr. Nguyen, in addition to the fire prevention and control requirements for residential spaces, more stringent and stringent conditions are necessary for spaces that combine production and business activities to prevent fire and explosion incidents.

Specifically, the law and its subsequent guiding documents will require that the production and business areas be separated from the residential areas by partitions. For businesses with a higher level of fire and explosion risk, there must be partitions and escape routes separating the residential area from the production and business area. Sleeping areas are not permitted within the production and business zone. There must be escape signs, fire alarms, ventilation, and fire and explosion safety warnings.

“A new point in the law is that for the combination of residential and production/business spaces, devices that report fires to the city’s fire and explosion incident handling center must be installed. Even if humans fail to detect a fire, the warning device will transmit the information to the center for timely response,” Mr. Nguyen added.

At 23:03 on December 18, the Hanoi Public Security Command and Control Center received a report of a fire at a cafe located at 258 Pham Van Dong, Co Nhue 2, Bac Tu Liem District. The cafe was a four-story concrete building with a first floor cafe area of approximately 40 square meters. The incident resulted in the tragic deaths of 11 individuals. On December 19, the Hanoi Public Security issued a decision to initiate a criminal investigation and prosecute Cao Van Hung (born 1973, residing in Dai Mach commune, Dong Anh district, Hanoi) for arson.
