![]() A Mechanism and Special Policies Are Needed for the Development of the Urban Railway System in Hanoi and Ho Chi Minh City

On February 4, the Ministry of Justice organized a meeting to review the proposal to build a resolution of the National Assembly on piloting mechanisms and special policies for the development of the urban railway system in Hanoi and Ho Chi Minh City until 2035.
The opinions at the meeting assessed that the investment in urban railway lines in the two cities has been slow and has not met the goals, development needs, and traffic congestion reduction requirements in the past.
Therefore, the construction of this resolution is necessary to mobilize all legal resources for investment, maximize the simplification of procedures, preparation time, implementation progress, human resource training, and efficient land fund exploitation. It also aims to decentralize and devolve powers to the two cities in implementing investments that match their practical situation, characteristics, and development needs.
The draft resolution, presented by the Government to the National Assembly, proposes eight groups of special mechanisms and policies related to capital mobilization, investment procedures, Transit-Oriented Development (TOD) model implementation, railway industry development, technology transfer, and human resource training. It also includes policies on construction materials and waste disposal sites, anti-corruption measures, and specific policies for Ho Chi Minh City, along with implementation organization.
Regarding the proposal to issue government bonds to supplement the annual budget and investment plans for urban railway projects and TOD-model urban railway projects, the Ministry of Finance requested the drafting agency to clarify the legal basis for this suggestion. They also recommended reviewing the consistency with the Law on Public Debt Management and the Law on State Budget to ensure a unified and integrated legal system.
The draft resolution also proposes that the project be designed with a Front-End Engineering Design (FEED) study, replacing the basic design in the project’s feasibility report. Commenting on this, the Ministry of Construction requested the drafting agency to assess the feasibility of this proposal further and clarify the contents related to the FEED study.
Based on the contributions and discussions, Deputy Minister of Justice Nguyen Thanh Tinh requested the drafting agency to review and complete the proposal and draft resolution. He emphasized that the resolution must provide special mechanisms and policies and serve as an effective solution for the development of the urban railway system in Hanoi and Ho Chi Minh City.
The Deputy Minister also asked the drafting agency to provide further clarification on achieving the draft resolution’s objectives, such as attracting resources, streamlining procedures, maximizing decentralization and delegation of powers, and ensuring the economic and social efficiency of the projects.
Additionally, they should supplement provisions on the responsibilities of competent authorities in implementing the resolution, specifically the monitoring, inspection, supervision, and accountability of Party committees, People’s Committees, and People’s Councils, to ensure the prevention of corruption, negativity, and vested interests.
