On February 4th, sources informed Tien Phong that the People’s Committee of Tien Giang province had issued a notice revoking land due to violations of land laws by Hoang Kim Nhung Co., Ltd. (based in Phu Nhuan District, Ho Chi Minh City).

The My Phuoc Tay People’s Cemetery Park lies abandoned.

According to documents, on March 19, 2014, the People’s Committee of Tien Giang province issued Decision 577/QD-UBND, approving the result of direct investor selection for the My Phuoc Tay People’s Cemetery Park project.

Hoang Kim Nhung Co., Ltd. was chosen as the investor, and on December 19, 2014, the People’s Committee of Tien Giang province issued Decision 3366/QD-UBND, allocating land to the company for project implementation.

The My Phuoc Tay People’s Cemetery Park covers an area of 48,942.1 square meters. The land use term is from the date of the decision until August 20, 2064, with the state allocating land with land use levy collection. The total amount to be paid is over 12.4 billion VND.

After receiving the land handover, the investor carried out procedures for construction permits and constructed a perimeter fence, a caretaker’s house, a funeral hall, erected Buddha statues, and other structures for burial services, planted trees, and built roads within the premises.

On September 14, 2018, the Department of Natural Resources and Environment issued Official Letter 4875/STNMT-CCMT on the official operation of the My Phuoc Tay People’s Cemetery Park by Hoang Kim Nhung Co., Ltd. However, as observed, all constructed facilities are currently dilapidated and abandoned.

As of May 6, 2024, the company has paid 5 billion VND into the state budget. The total amount of tax arrears as of the same date is over 13 billion VND.

Due to the company’s failure to fulfill its land use levy obligations, the Cai Lay Tax Department issued Decision 314/QD-CCT on March 12, 2020, on enforcing administrative tax decisions by forcibly collecting money from the company’s bank account.

However, the company’s payment account had no balance to execute the enforcement decision. At the time of the inspection, the company had not yet paid the full land use levy into the state budget.

Considering the proposal of the Department of Natural Resources and Environment of Tien Giang province, the People’s Committee of Tien Giang province issued a notice revoking the land due to violations of land laws by Hoang Kim Nhung Co., Ltd., with an area of 48,942.1 square meters. The reason for the revocation is the investor’s violation of Point g, Clause 1, Article 64 of the 2013 Land Law; Article 15a of Decree No. 43/2014/ND-CP, supplemented at Clause 13, Article 2 of Decree No. 01/2017/ND-CP (now Clause 6, Article 81 of the 2024 Land Law; Point b, Clause 1, Article 32 of Decree No. 102/2024/ND-CP).
