The Hanoi People’s Committee is proposing a resolution to exempt land rental fees for projects using land for production and business purposes in the city. The draft resolution focuses on projects in the fields of investment incentives or preferential investment locations as stipulated in Point a, Clause 1, Article 157 of the Land Law.

According to the draft, projects using land for production and business purposes in the fields or locations eligible for investment incentives (referred to as land-using projects) will be exempt from land use fees if they meet “one of two” conditions.

Specifically, projects that fall under the category of socio-economic development and meet the criteria, scales, and social norms issued together with Decision No. 1466/QD-TTg dated October 10, 2008, and its amendments (referred to as socio-economic projects), or non-profit projects as defined by the law, will be eligible for exemption.

Regarding investment incentives, the draft proposes a land rental fee exemption for the entire lease term (up to 50 years) for non-profit projects located within the city. Additionally, socio-economic projects implemented in specific areas, including the Hoa Lac Hi-tech Park and the districts of Dong Anh, Me Linh, and Soc Son, which are envisioned to become models for developing cities under the city’s jurisdiction according to Resolution No. 15 of the Political Bureau, will also be exempt from land rental fees for up to 50 years.

For socio-economic projects in other areas, the proposal suggests a full exemption from land rental fees (up to 50 years) for projects in the fields of education, vocational training, healthcare, culture, sports, and environmental protection.

For socio-economic projects in other sectors located in the city’s districts, a 15-year exemption is proposed after the initial construction period. Meanwhile, for projects in the districts of Ba Vi, My Duc, Phuc Tho, Chuong My, and Phu Xuyen, a 30-year exemption is suggested after the construction period.

In cases where a project spans multiple districts or towns with different incentive levels, the land rental fee exemption will be calculated based on the proportion of the project’s land area corresponding to each location or area.

To qualify for the exemption, projects must align with provincial planning, sectoral planning, construction planning, and local land use plans. Additionally, they must be implemented and operated according to the approved schedule, objectives, and investment scale.

The resolution is expected to be considered and approved by the Hanoi People’s Council at its 21st session, which will be held in the near future.
