Regarding the above conditions, citizens are wondering if there are specific regulations on how to represent the pathway on the land parcel diagram and the land certificate (red book).
In response to this query, the Ministry of Natural Resources and Environment shared that concerning the representation of pathways when dividing or consolidating land parcels as per the provisions of Article 220 of the Land Law, Point a, Clause 6, Article 13 of Circular No. 26/2024/TT-BTNMT dated November 26, 2024, of the Minister of Natural Resources and Environment stipulates technical guidelines for cadastral surveying and mapping as follows: “… In cases of land parcel division or consolidation that result in the formation of a pathway, the pathway shall be represented as a separate land parcel with the notation ‘pathway’ on the cadastral map.”

The representation of the land parcel diagram on the land certificate is governed by the provisions of Clause 1, Article 39 of Circular No. 10/2024/TT-BTNMT dated July 31, 2024, of the Minister of Natural Resources and Environment, which stipulates the dossiers on land, the Certificate of Land Use Rights, ownership of houses and other land-attached assets, and Appendix 03 – Guidelines for Land Parcel Diagrams and Land-Attached Assets, issued together with Circular No. 10/2024/TT-BTNMT.
Clause 1, Article 39 of Circular No. 10/2024 stipulates the following: 1. The land parcel diagram shall be presented as follows: a) The land parcel diagram shall include the following information: – Information on the parcel number, area, shape, coordinates of parcel vertices, and length of parcel sides; – Number or name of adjacent parcels or adjacent structures, with an indication of the North-South direction; – Planning boundaries and markers for safe construction corridors on the land parcel shall be represented by dashed lines with dots, accompanied by a note indicating the type of boundary or marker; – In cases where a land parcel has a portion of land for exclusive use by one person and a portion of land for common use by multiple people, the boundary between these portions shall be represented by dashed lines with dots, accompanied by a note indicating the purpose of that boundary. If the land parcel includes an apartment building or a non-residential structure, and the common area of the owners constitutes a portion of the land parcel, the scope of the common area boundary must be indicated; b) Cases where a land parcel diagram is not required include: – Land use right certificates issued for multiple agricultural land parcels; – Land use right certificates issued to agricultural and forestry companies, except when the land is used for the construction of company headquarters; – Land use right certificates issued for the entire land area for real estate projects; – Geographic objects in the form of lines, such as “Transport routes, power transmission lines, water supply lines constructed by organizations in the form of Build-Operate-Transfer (BOT) |
