On May 8, sources revealed that the Inspectorate of Binh Thuan Province issued Conclusion No. 02/KL-TTBT, pointing out serious violations in the issuance of land use right certificates (LURC) contrary to regulations in Tien Thanh ward, Phan Thiet city.

The agency has recommended transferring the entire dossier to the Investigation Police Agency to clarify signs of criminal offenses.

The case involves LURC No. AM 176732 issued by the People’s Committee of Phan Thiet City in 2008 to Mr. L.T.V.

The certificate shows that the land area is over 21,000 square meters, but in reality, it did not meet the conditions for certification and showed signs of forged documents.

According to the inspection conclusion, this land plot belongs to public land and is managed by the state. However, Mr. N.H.S.L., then a commune-level land official in Tien Thanh, wrongly confirmed the land’s origin and legalized the dossier to convert public land into private land.

Mr. L. also recorded an increase in land area of nearly 4,300 square meters compared to the actual size and allowed unauthorized persons to sign the declaration and confirm the land origin.

The dossier was then further “legalized” at the city level. Officers of the Department of Natural Resources and Environment of Phan Thiet City failed to inspect and verify the site but still proposed the issuance of the LURC.

The document was signed and sealed even though it contained many inaccurate contents and lacked legal basis. The individuals involved were determined to have been negligent or willfully acted against the law, resulting in serious consequences.

After obtaining the LURC, the land plot was transferred multiple times, divided into several smaller plots, and is now owned by different individuals, making it challenging to retrieve and resolve the issue.

Given these violations, the provincial inspectorate concluded that there were indications of the crimes of “abuse of position and power while performing official duties” and “negligence causing serious consequences.”

The inspectorate recommended transferring the entire case dossier to the Investigation Police Agency of Binh Thuan Province for handling in accordance with the law.
