Immediate Access to Retirement Pension

Mr. Doan Trung, a civil servant born in 1972 from Tien Giang Province, has 23 years of mandatory social insurance contributions. Mr. Trung voluntarily applied for early retirement under Decree No. 178/2024/ND-CP, falling under the category of individuals with 5 to 10 years left until the official retirement age.


Mr. Trung asks if he will receive his retirement pension (pension book) immediately after obtaining the decision for early retirement.

Regarding this query, the Ministry of Home Affairs stated that Mr. Trung’s situation is addressed in Article 4 of Circular No. 01, dated January 17, 2025, issued by the Minister of Home Affairs. This circular provides guidance on policies and regimes for officials, public employees, civil servants, and laborers affected by the reorganization of the political system’s apparatus (as amended and supplemented in Circular No. 002, dated April 4, 2025).

According to the circular, individuals who fall under the category of early retirement as stipulated in Decree No. 178 (amended and supplemented in Decree No. 67) are entitled to immediate retirement pensions as per the law on social insurance.

Additionally, Mr. Trung is eligible for two more preferential treatments: he will not face any reduction in his retirement pension due to early retirement, and he will receive allowances as outlined in Decree No. 178.


Which Allowances are Included in the Redundancy Scheme?

Ms. Nhu Huong, a chief accountant, receives a position allowance with a coefficient of 0.2 in addition to her salary.


Ms. Huong is unsure if this responsibility allowance is considered part of her current monthly salary for the calculation of benefits when leaving her job under Decree No. 178.

In response to this inquiry, the Ministry of Home Affairs clarified that the current monthly salary used for calculating benefits during organizational restructuring is defined in Clause 6, Article 5 of Decree No. 178, which has been amended and supplemented by Clause 3, Article 1 of Decree No. 67.

Specifically, the current monthly salary comprises the salary of the immediate preceding month before leaving the job, including: the salary level according to the rank, grade, rank, position, professional title, or the agreed-upon salary in the labor contract; salary allowances; and the coefficient of preserved salary difference (if any).

According to the Ministry of Home Affairs, the chief accountant’s allowance is not considered part of the current monthly salary for benefit calculations under Decree No. 178.
