On May 7, an inspectorate source revealed that the Government Inspectorate has announced the inspection results of planning, investment, construction, and land management and use in Can Tho city, pointing out multiple violations.

Regarding land management and use, the Government Inspectorate concluded that the former Department of Natural Resources and Environment had issued over 2,000 land use certificates to 23 economic organizations implementing 26 projects, with permanent land use duration, violating the 2013 Land Law. Some cases of issuing certificates for the first time to households and individuals also lacked proper dossiers, and some land plots were not suitable for planning purposes.

The Government Inspectorate pointed out numerous violations in land management in Can Tho city.

In terms of land management in industrial parks, the inspection specifically mentioned Hung Phu 1 Industrial Park, where the Saigon – Can Tho Industrial Park Joint Stock Company, the investor, leased land from the state from 2008 but had signed a contract to lease land to Saigon Construction Joint Stock Company since 2006, violating regulations.

At Thot Not Industrial Park Phase 3, the Thot Not Industrial Park Infrastructure Development Center had not been leased land by Can Tho People’s Committee and had not yet invested in infrastructure but still signed a land lease contract. The land lease amount was over VND 108 billion, but the management and use of this amount have not been clarified.

Regarding the issuance of land price tables, according to the inspection conclusions, Can Tho People’s Committee did not issue land price adjustment coefficients for three years (2018-2020); land prices were not close to market prices and were slow to adjust when there were significant fluctuations, leading to inaccurate determination of financial land obligations.

Particularly, in the resettlement project in Ninh Kieu district (An Binh ward), compensation, support, and resettlement were not in accordance with regulations, causing damage of over VND 1 billion. In total, the amount of money that must be collected into the state budget due to land use debt, land rent, and investment security deposit by the end of 2022 has amounted to over VND 400 billion.

The Government Inspectorate requested the Can Tho People’s Committee and the City’s Chairman to direct and organize the serious implementation of the inspection conclusions, rectify, overcome, and strictly handle the existing shortcomings, limitations, and violations. During the implementation process, if there are acts that cause state property loss or signs of legal violations, the case must be immediately transferred to the police for handling in accordance with regulations.

In terms of economic handling, the Government Inspectorate recommended collecting over VND 463 billion to the state budget and deducting over VND 2.5 billion during the project settlement due to violations in investment, construction, and land management and use.

The Inspectorate also proposed that the Can Tho People’s Committee direct the inspection and review of the adjustment of manpower and construction machine prices that are not in accordance with the law in 18 projects, with a provisional amount of nearly VND 20 billion. If there are signs of crime, the case must be transferred to the police.

At the same time, Ninh Kieu District People’s Committee needs to review and collect an amount of over VND 1 billion (provisional amount) due to compensation and support that do not comply with regulations related to the district’s resettlement area project.

The Can Tho People’s Committee and the City’s Chairman are also requested to organize reviews and clarify the responsibilities of collectives and individuals involved; direct localities and branches to review and clarify responsibilities for the existing shortcomings and violations.

The Government Inspectorate also proposed that the Ministry of Public Security direct competent agencies to receive information related to violations at the Thot Not Industrial Park Infrastructure Center (Phase 3) regarding three land lease contracts of two enterprises for consideration and handling in accordance with regulations. These include two contracts signed with Wilmar Agro Vietnam Co., Ltd. (in 2010 and 2014) and one contract signed with Truong Hai Auto Corporation (in 2016).
