The Ministry of Home Affairs is seeking feedback on the draft Decree determining the authority in the field of Home Affairs when organizing a two-level local government.

The Ministry of Home Affairs emphasizes that the purpose of issuing the Decree is to ensure compliance with the Constitution and provide a legal basis for the normal, continuous, and smooth operation of the agencies; to avoid disruptions, overlaps, or gaps in functions, tasks, fields, and areas; and to prevent any negative impact on the normal life of society, citizens, and businesses.
The draft Decree details the tasks and powers in the field of Home Affairs that will be transferred to the communal and provincial authorities when implementing a model without a district-level government.
Accordingly, 120 contents belonging to 8 fields (state archives and archives, emulation and rewards, salaries – social insurance, employment, occupational safety, personnel organization, youth and gender equality, non-governmental organizations, and merit) will be transferred from the district to the communal level.
At the same time, 21 contents belonging to 4 fields (state archives and archives, emulation and rewards, salaries – social insurance, employment, and occupational safety) will be transferred from the district to the provincial level.
Regarding the principles of authority determination, the Ministry of Home Affairs clarified that the communal level mainly implements policies issued by the central and provincial levels, focusing on tasks that serve the people and directly solve community issues, providing basic and essential public services to residents in the area.
The new communal-level government will assume the tasks and authority of the current communal and district-level local governments.
Meanwhile, the provincial-level government will manage, inspect, and supervise the activities of the communal-level government.
The Ministry of Home Affairs expects the Decree to take effect from July 1, 2025, and end on February 28, 2027.
