On the morning of May 14, during the trial for illegal rare earth mining, the prosecutor presented the indictment and proposed sentences for each defendant.

The prosecutor’s argument stated that it was unnecessary to isolate defendant Nguyen Linh Ngoc, the former Deputy Minister of TN&MT, from society. They recommended a suspended sentence of 30-36 months’ imprisonment for the charge of “Violation of regulations on the management and use of state assets, causing loss and waste.”

The prosecutor proposed the following sentences for the other defendants:

Doan Van Huan, Chairman and CEO of Thai Duong Company: 12-15 years’ imprisonment for three charges, including Violation of regulations on research, exploration, and exploitation of natural resources; Violation of accounting regulations causing serious consequences; and Environmental pollution.

Luu Anh Tuan, Chairman of the Board of Rare Earth Vietnam Joint Stock Company: 16-18 years’ imprisonment.

Nguyen Van Thuân, former Director-General of the General Department of Geology and Minerals of the Ministry of TN&MT: 5-6 years’ imprisonment.

Hoang Van Khoa, former head of the Mineral Resources Department – General Department of Geology and Mineral Resources: 3 years and 6 months to 4 years and 6 months’ imprisonment.

Ho Duc Hop, former director of the Yen Bai Provincial Department of Natural Resources and Environment: 3 years and 6 months to 4 years and 6 months’ imprisonment.

Le Duy Phuong, former senior official of the Mineral Resources Department – General Department of Geology and Mineral Resources: 4-5 years’ imprisonment.

Le Cong Tien, former deputy director of the Yen Bai Provincial Department of Natural Resources and Environment: 30-36 months’ imprisonment.

Bui Doan Nhu, former deputy head of the Environmental Protection Division – Yen Bai Provincial Department of Natural Resources and Environment: 24-30 months’ imprisonment.

For the remaining defendants, the prosecutor recommended sentences ranging from 24 months’ suspended sentence to 10 years’ imprisonment.

According to the prosecutor’s argument, the indictment of the defendants is correct in terms of the accused, the crime, and the law. The defendants’ criminal acts pose a danger to society. The defendants have expertise in their respective fields, but they disregarded the law to serve their personal interests and those of their businesses.

Regarding the defendants from the Ministry of TN&MT, they should have acted as gatekeepers for the government and the People’s Committee of Yen Bai Province. Instead, they granted permits to the Thai Duong Company despite their lack of qualifications. Their criminal acts warrant severe punishment to ensure deterrence and prevent similar incidents in the future.

The prosecutor also took into consideration the defendants’ awards and their families’ contributions to the revolution, treating these as mitigating factors.

In terms of civil liability, the prosecutor stated that only defendant Huan should compensate for the damage caused, as he was the one who benefited from the illegal mining. The value of the illegally exploited natural resources was estimated to be over 763 billion VND.
