Strict handling of inspection and examination abuses

This morning (May 15), the National Assembly listened to Minister of Finance Nguyen Van Thang, on behalf of the Prime Minister, presenting the draft resolution of the National Assembly on mechanisms and policies to develop the private economy.

Accordingly, the draft resolution stipulates that inspections and examinations of enterprises, business households, and business individuals shall not exceed once a year, except in cases of obvious violations.

Notably, inspection and examination plans and conclusions must be publicized in accordance with the law. Strict handling of inspection and examination abuses that cause harassment and difficulties for businesses, households, and business individuals.

Remote inspections and examinations based on electronic data are prioritized, reducing direct inspections and examinations.

On-site inspections are waived for businesses, business households, and business individuals who comply with the law…

In the proposal, according to Minister Nguyen Van Thang, for civil and economic violations, civil, economic, and administrative measures are prioritized; businesses, business households, and business individuals are given the initiative to remedy violations and damages.

In cases where the application of law may lead to criminal prosecution or non-prosecution, criminal prosecution shall not be applied.

Even for violations that warrant criminal prosecution, proactive, timely, and comprehensive economic remedial measures are prioritized. This is also an important basis for investigative agencies to consider when deciding on prosecution, investigation, indictment, trial, and subsequent handling measures.

Retroactive application of legal provisions shall not be used to the detriment of businesses, business households, and business individuals.

For cases where information, documents, and evidence are not clear enough to conclude that there has been a violation of the law, a conclusion shall be drawn promptly in accordance with the provisions of procedural law, and this conclusion shall be made public…

Regarding administrative procedure reform, the provisions of the draft are built on the principle of simplifying administrative procedures, reducing adverse effects in state management, and creating the most favorable conditions for the production and business activities of the people and enterprises.

Expanding private sector participation in key projects

To achieve the goal of having at least 20 large private enterprises participating in the global value chain by 2030, the draft resolution proposes two groups of policies.

First, the implementation of key and important national projects through restricted bidding or direct appointment.

Accordingly, the state expands the participation of private enterprises in key and important national projects through direct investment or public-private partnership or other cooperation models between the state and the private sector in accordance with the law.

The competent authority and the investor choose the form of restricted bidding, direct appointment, or other forms prescribed by law to implement strategic and key national projects (high-speed railways, urban areas, fundamental and leading industries, energy, digital, green transport, national defense, security, and emergency tasks) ensuring transparency, quality, and progress.

Second, support the formation and development of medium and large enterprises and private economic groups on a regional and global scale.

The state allocates the budget for two programs to support medium and large enterprises and private economic groups: one is to develop 1,000 typical enterprises in science and technology, innovation, digital transformation, green and high-tech industries, and auxiliary industries; the second is to support the expansion into international markets, providing support in terms of markets, capital, technology, brands, distribution, logistics, insurance, legal consulting, dispute resolution, and connections with multinational corporations.
