The Ministry of Finance has issued a document guiding the handover, management, and disposition of public assets, including infrastructure assets, publicly-owned assets, and assets of projects using state capital in the context of administrative unit rearrangement and reorganization.

Specifically, for infrastructure assets currently managed by communal-level authorities, the new communal-level administrative units formed after the rearrangement will be responsible for inheriting the management and use of these assets from the old communal-level units.

In cases where an old communal-level unit is divided into multiple new units, the new units will inherit the management and use of the infrastructure assets located within their respective jurisdictions.

If the assets span multiple new communal-level jurisdictions, the provincial People’s Committee Chairman will decide which new unit or provincial-level agency will be responsible for inheriting their management and use.

Regarding infrastructure assets currently managed at the district level, for irrigation and market infrastructure assets, the new communal-level units will be responsible for inheriting the management and use of these assets located within their respective jurisdictions.

If the assets span multiple new communal jurisdictions, the provincial People’s Committee Chairman will decide which new communal unit or provincial-level agency will be the recipient.

For other types of infrastructure assets, based on the list of assets managed by district-level People’s Committees, agencies, organizations, and units under their management or temporary management, the district-level People’s Committees shall be responsible for compiling and reporting to the specialized agencies managing industries and fields under the provincial People’s Committees. These specialized agencies will then report to the provincial People’s Committee Chairman, who will decide which provincial-level agency or new communal unit will inherit their management and use.

Concerning infrastructure assets currently managed at the provincial level, the new provincial-level administrative units formed after the rearrangement will be responsible for inheriting the management and use of these assets from the old provincial-level units.

Publicly-owned assets

For assets managed by management units that are agencies, organizations, or units under the communal level, and which have not been disposed of by the time of the administrative unit rearrangement, the new communal-level units will be responsible for inheriting their management.

In cases where an old communal-level unit is divided into multiple new units, the provincial People’s Committee will specifically determine which new communal unit will be responsible for inheriting the management, disposal, and handling of these assets.

For assets managed by management units that are agencies, organizations, or units under the district level, and which have not been disposed of by the time the district-level administrative unit is dissolved, the provincial People’s Committee Chairman will assign a specialized agency under the provincial People’s Committee or a new communal unit to inherit their management, disposal, and handling in accordance with regulations.

For assets managed by management units that are agencies, organizations, or units under the provincial level, and which have not been disposed of by the time of the provincial administrative unit rearrangement, the new provincial-level units formed after the rearrangement will be responsible for inheriting their management and handling.

For assets managed by central agencies that are no longer operational due to organizational restructuring in line with administrative unit rearrangement, the minister or head of the central agency shall decide which agency or unit under the ministry or central agency will be responsible for inheriting their management.

Assets of projects using state capital

Regarding assets serving the activities of projects, refer to the Ministry of Finance’s documents number 13749 dated December 14, 2024, number 2454 dated February 28, 2025, and number 4891 dated April 15, 2025.

For assets that are the results of completed projects, the minister, head of the central agency, or provincial People’s Committee shall direct the project management unit or investor (in cases where there is no project management unit or the unit has been dissolved) to conduct a review and complete the handover of assets to the beneficiary in accordance with regulations (for projects with specified beneficiaries). This includes providing complete information on the value of the assets to facilitate the beneficiary’s management and accounting after the handover.

Report to the competent authority for consideration and decision on asset handling in accordance with the law (for projects without specified beneficiaries). If asset handling has not been completed by the time of the administrative unit rearrangement, refer to the principles outlined in points a, b, and c of the section on publicly-owned assets.

For ongoing projects, refer to the Ministry of Finance’s document number 4738 dated April 14, 2025.

Regarding the management of temporary accounts at the State Treasury, where the Finance and Planning Office of the district-level People’s Committee is the account holder managing revenues from the management, handling, and exploitation of public assets, the Office shall transfer the funds to a temporary account with the provincial-level Finance Office as the account holder. The provincial-level Finance Office shall notify the agencies, organizations, and units with revenues to carry out payment procedures with the provincial-level Finance Office.

The provincial-level Finance Office shall be responsible for managing the funds in the temporary account in accordance with the law.
