## **National Assembly Passes Resolution on Special Mechanisms and Policies for Law Building and Enforcement**

On the morning of May 17, under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly passed a resolution on special mechanisms and policies to create a breakthrough in law building and enforcement. The resolution was approved by 416 out of 443 delegates, a rate of 93.90%.

One notable content of the resolution is the regulation on monthly support equivalent to 100% of the salary according to the current wage coefficient (excluding allowances) for those directly and regularly engaged in strategic research and policy advice, and law making in a number of agencies and units.

The beneficiaries of this policy include full-time National Assembly and Provincial People’s Council delegates; leaders, civil servants, and military officers in armed forces holding positions related to law making, legal affairs, inspection of legal documents, and international dispute resolution; and researchers from agencies listed in Appendix I attached to the resolution.

In the event that the agencies and units listed in Appendix I undergo changes in their names, functions, or organizational models, the determination of beneficiaries will be carried out in accordance with government regulations.

In addition, subjects belonging to Party agencies, the Vietnam Fatherland Front, as regulated by the authorized agency of the Party; subjects belonging to ministries, ministerial-level agencies, and local governments as regulated by the government; and other subjects as regulated by the National Assembly Standing Committee may also be eligible for support if they meet the requirement of directly and regularly engaging in policy and strategy advice and law making.

This support is not applicable to those holding leadership positions from deputy minister and equivalent levels onwards, except for a few specific cases mentioned. The allowance is paid together with the salary and is not considered for social insurance contributions and benefits.

Notably, income from law-making activities under this resolution will be exempt from personal income tax and other financial obligations to the state. If an employee falls under multiple categories of beneficiaries, only the highest level of support will be applied.

Supplementary Principles to Control and Prevent Policy Abuses

Presenting the report on reception, explanation, and amendment of the draft resolution, Minister of Justice Nguyen Hai Ninh, authorized by the Prime Minister, stated that the government has received and amended the content to institutionalize Regulation 178-QD/TW of the Politburo.

Specifically, Article 3 of the resolution was supplemented with the principle of “ensuring the improvement of quality and efficiency in law building and enforcement, meeting the development requirements of the country in the new era.”

Clause 3 of this article was modified to clarify the requirement that the application of special mechanisms and policies must be accurate in terms of subjects, management transparency, efficiency, and economy; while also preventing corruption, wastefulness, negativity, vested interests, and policy abuses.

The drafting agency also added a principle with a disciplinary nature in clause 4: “Strictly handling acts of corruption, negativity, vested interests, and sectarianism in law building and enforcement in a manner commensurate with the nature and extent of the violation through party disciplinary measures, administrative disciplinary measures, administrative violation handling measures, and criminal handling measures in accordance with the regulations of the Party and the laws of the State.”

Policy Support Fund Will Not Finance Specific Legal Documents

Regarding the proposal to establish a Policy and Law Building Support Fund, some opinions in the National Assembly expressed concern about the risk of forming vested interests if socialized funding is allowed.

On this matter, Minister Nguyen Hai Ninh affirmed: “The establishment of the Fund mainly aims to support early policy research to proactively evaluate and select policies as a basis for building legal documents in accordance with the direction of the Politburo; it does not focus on supporting the construction of specific legal documents (except for a few projects, tasks, and activities that require additional funding).”

Therefore, although the Fund can receive legal extra-budgetary support, it will not be used to directly finance legislative projects, making it difficult to specifically influence normative content.

The government also commits to strictly regulating the conditions in the draft decree providing guidance on implementation. It is expected that representatives from the Ministry of Public Security and the Ministry of National Defense will participate in the supervision of the Fund’s Management Board to ensure transparency, efficiency, and prevention of policy abuses.
